حَدَّثَنَا مُحَمَّدُ بْنُ عِمْرَانَ، عَنْ مُعَاوِيَةَ بْنِ مَيْسَرَةَ بْنِ شُرَيْحٍ، عَنْ شريح بْنِ الْحَارِثِ، قَالَ: "اخْتُصِمَ إِلَى شُرَيْحٍ فِي بِنْتَيْنِ، وَأَبَوَيْنِ، وَزَوْجٍ، فَقَضَى فِيهَا، فَأَقْبَلَ الزَّوْجُ يَشْكُوهُ فِي الْمَسْجِدِ، فَأَرْسَلَ إِلَيْهِ عَبْدَ اللَّهِ بْنَ رَبَاحٍ فَأَخَذَهُ، وَبَعَثَ إِلَى شُرَيْحٍ، فَقَالَ: مَا يَقُولُ هَذَا ؟ قَالَ: هَذَا يَخَالُنِي امْرَأً جَائِرًا، وَأَنَا إِخَالُهُ امْرَأً فَاجِرًا، يُظْهِرُ الشَّكْوَى وَيَكْتُمُ قَضَاءً سَائِرًا، فَقَالَ لَهُ الرَّجُلُ: مَا تَقُولُ فِي بِنْتَيْنِ، وَأَبَوَيْنِ، وَزَوْجٍ ؟ فَقَالَ: لِلزَّوْجِ الرُّبُعُ مِنْ جَمِيعِ الْمَالِ، وَلِلْأَبَوَيْنِ السُّدُسَانِ، وَمَا بَقِيَ فَلِلِابْنَتَيْنِ، قَالَ: فَلِأَيِّ شَيْءٍ نَقَصْتَنِي ؟ قَالَ: لَيْسَ أَنَا نَقَصْتُكَ، اللَّهُ نَقَصَكَ، لِلِابْنَتَيْنِ الثُّلُثَانِ، وَلِلْأَبَوَيْنِ السُّدُسَانِ، وَلِلزَّوْجِ الرُّبُعُ، فَهِيَ مِنْ سَبْعَةٍ وَنِصْفٍ فَرِيضَةً، فَرِيضَتُكَ عَائِلَةٌ".
Ayyub bin al-Harith said: A case involving two girls, a mother and father, and a husband came before Judge Shurayh, and he gave a verdict in it (i.e., without ‘awl, thus reducing the share). So the husband complained about this in the mosque. Abdullah bin Rabah summoned Judge Shurayh and asked him: What do you say about this? He replied: This man thinks I am unjust, and I consider him immoral because he gave a fatwa and concealed the full verdict. The man said: Then what do you say about two girls, a mother and father, and a husband? He said: The husband gets a quarter of the entire estate, and the mother and father each get one-sixth (i.e., six and six), and what remains is for the girls. What deficiency have I made for you? Abdullah bin Rabah said: I have not made any deficiency for you; Allah Almighty has stated your deficiency. For the two girls, two-thirds (four), for the parents, two sixths (1, 1), and for the husband, a quarter. And this issue will be calculated from seven and a half, and in this issue, ‘awl must be applied.
