باب في الْعَبْدِ يَكُونُ بَيْنَ الرَّجُلَيْنِ فَيَعْتِقُ أَحَدُهُمَا نَصِيبَهُ:Chapter on a slave owned by two men, and one frees his share
Hadith 3171
حَدَّثَنَا مُحَمَّدُ بْنُ عِيسَى، حَدَّثَنَا هُشَيْمٌ، أنبأنا يُونُسُ، عَنْ الْحَسَنِ . ح وحَدَّثَنَا جَرِيرٌ، عَنْ أَبَانَ بْنِ تَغْلِبَ، عَنْ الْحَكَمِ، عَنْ إِبْرَاهِيمَ، أَنَّهُمَا قَالَا: "إِنْ ضَمِنَ، كَانَ الْوَلَاءُ لَهُ، وَإِنْ اسْتَسْعَى الْعَبْدُ، كَانَ الْوَلَاءُ بَيْنَهُمْ".
It is narrated from Aban bin Taghlib, Hakam and Abu Nu'aim said: If someone becomes a guarantor, then the right of wala' will be his. And if a slave is made to work for his freedom, then the right of inheritance will be divided among the owners.
