Hadith 2899

أَخْبَرَنَا أَخْبَرَنَا يَزِيدُ بْنُ هَارُونَ، أَنْبَأَنَا شَرِيكٌ، عَنْ الْأَعْمَشِ، عَنْ إِبْرَاهِيمَ، قَالَ: قَالَ عَبْدُ اللَّهِ: كَانَ عُمَرُ إِذَا سَلَكَ بِنَا طَرِيقًا وَجَدْنَاهُ سَهْلًا، وَإِنَّهُ قَالَ فِي زَوْجٍ وَأَبَوَيْنِ: "لِلزَّوْجِ النِّصْفُ، وَلِلْأُمِّ ثُلُثُ مَا بَقِيَ.
Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) said: When Sayyiduna Umar (may Allah be pleased with him) was with us on any path, we found it easy. He said regarding the share of the husband and the parents that the husband will get half and the mother will get one third of the remaining wealth.
Brief Explanation
(Commentary on Hadith 2898)
The situation is as follows: A woman passed away, leaving behind her husband and parents. Thus, half of the total estate will go to the husband, and from the remainder, one third will go to the mother, and whatever remains after that will go to the father as ‘asabah (agnatic heir). The issue will be calculated out of 6 shares.
