Hadith 2305

حَدَّثَنَا فَرْوَةُ بْنُ أَبِي الْمَغْرَاءِ، حَدَّثَنَا عَلِيُّ بْنُ مُسْهِرٍ، عَنْ هِشَامِ بْنِ عُرْوَة، عَنْ أَبِيهِ، عَنْ عَائِشَةَ، قَالَتْ: طَلَّقَ رِفَاعَة رَجُلٌ مِنْ بَنِي قُرَيْظَةَ امْرَأَتَهُ فَتَزَوَّجَهَا عَبْدُ الرَّحْمَنِ بْنُ الزُّبَيْرِ، فَدَخَلَتْ عَلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقَالَتْ: يَا رَسُولَ اللَّهِ، وَاللَّهِ إِنْ مَعَهُ إِلَّا مِثْلُ هُدْبَتِي هَذِهِ، فَقَالَ لَهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: "لَعَلَّكِ تُرِيدِينَ أَنْ تَرْجِعِي إِلَى رِفَاعَةَ ؟ لَا، حَتَّى يَذُوقَ عُسَيْلَتَكِ أَوْ قَالَ تَذُوقِي عُسَيْلَتَهُ".
Lady Aisha (may Allah be pleased with her) said: Sayyiduna Rifa’ah (may Allah be pleased with him), who was from Banu Qurayza, gave his wife three divorces. After that, Sayyiduna Abdur Rahman bin Zubair (may Allah be pleased with him) married her. Then that woman came to the Messenger of Allah (peace and blessings be upon him) and said: O Messenger of Allah! He (Abdur Rahman) has (a private part) like this piece of cloth (i.e., he is impotent and cannot have intercourse). The Messenger of Allah (peace and blessings be upon him) said: “Perhaps you want to return to Rifa’ah? No, this cannot happen until Abdur Rahman tastes your sweetness,” or he said, “until you taste his sweetness.”

Brief Explanation
(Commentary on Ahadith 2303 to 2305)

When a person gives his wife three divorces (talaq), it then becomes necessary that the woman marries another man without any precondition, and consummates the marriage with him. After this, the second husband must not marry and divorce her with the intention or condition of making her lawful (halalah) for the first husband; otherwise, such a marriage will be unlawful, and both the one who does this and the one for whom it is done are, according to the statement of the Messenger of Allah sallallahu alayhi wa sallam, accursed. In any case, it is established from the aforementioned ahadith that a woman can remarry her first husband after a triple divorce (talaq thalath) only when the second husband has, of his own accord, divorced her.
