باب في تَزْوِيجِ الْمُحْرِمِ:Chapter: Marriage Contract for the Pilgrim

حَدَّثَنَا أَبُو نُعَيْمٍ، حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ، عَنْ مَطَرٍ الْوَرَّاقِ، عَنْ رَبِيعَةَ بْنِ أَبِي عَبْدِ الرَّحْمَنِ، عَنْ سُلَيْمَانَ بْنِ يَسَارٍ، عَنْ أَبِي رَافِعٍ، قَالَ: "تَزَوَّجَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مَيْمُونَةَ حَلَالًا، وَبَنَى بِهَا حَلَالًا، وَكُنْتُ الرَّسُولَ بَيْنَهُمَا".
Sayyiduna Abu Rafi’ (may Allah be pleased with him) said: When the Messenger of Allah (peace and blessings be upon him) married Sayyidah Maymunah (may Allah be pleased with her), he was not in the state of Ihram, and when he consummated the marriage, he was also not in the state of Ihram. And I was the messenger between the two of them.
Brief Explanation
(Commentary on Hadith 1862)
Imam Tirmidhi rahimahullah states that there was a difference of opinion regarding the marriage of Umm al-Mu’minin Sayyidah Maymunah radi Allahu anha—specifically, where and in what state the Messenger of Allah sallallahu alayhi wa sallam married her. The correct view is that he sallallahu alayhi wa sallam married her on the way to Makkah. Some of the Companions said that he sallallahu alayhi wa sallam married her before donning the ihram (state of consecration), but this marriage became well-known after he had entered into ihram. Then, when the Messenger of Allah sallallahu alayhi wa sallam had exited the state of ihram, he consummated the marriage with her at the place of Sarif, which is at a distance of ten miles from Makkah (this is agreed upon). Sayyidah Maymunah radi Allahu anha passed away at that very place of Sarif where the Messenger of Allah sallallahu alayhi wa sallam had consummated the marriage with her, and she was also buried there.
From all these ahadith, it is established that a muhrim (one in the state of ihram) cannot contract his own marriage nor conduct the marriage of another while in the state of ihram.
