Hadith 1861

حَدَّثَنَا سُلَيْمَانُ بْنُ حَرْبٍ، حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ، عَنْ أَيُّوبَ، عَنْ نَافِعٍ، عَنْ نُبَيْهِ بْنِ وَهْبٍ: أَنَّ رَجُلًا مِنْ قُرَيْشٍ خَطَبَ إِلَى أَبَانَ بْنِ عُثْمَانَ وَهُوَ أَمِيرُ الْمَوْسِمِ، فَقَالَ أَبَانُ: لَا أُرَاهُ إِلا عِرَاقِيًّا جَافِيًا،"إِنَّ الْمُحْرِمَ لَا يَنْكِحُ وَلَا يُنْكِحُ" . أَخْبَرَنَا بِذَلِكَ عُثْمَانُ، عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ . سُئِلَ أَبُو مُحَمَّد: تَقُولُ بِهَذَا ؟ قَالَ: نَعَمْ.
Nabiyah bin Wahb narrated that a man from the Quraysh sent a marriage proposal to Aban bin Uthman, who was the Amir of Hajj that season. Aban said: "You seem just like an ignorant Iraqi. Indeed, a person in the state of Ihram can neither marry himself nor arrange a marriage for someone else. We received this information from Uthman (may Allah be pleased with him), from the Messenger of Allah (peace be upon him)." Imam Darimi (may Allah have mercy on him) was asked: "Do you also say the same?" He replied: "Yes (meaning, a person in Ihram should neither marry nor arrange a marriage)."

Brief Explanation
(Commentary on Hadith 1860)

It is mentioned in Sahih Muslim that Umar bin Ubaidullah bin Ma'mar wanted to marry his son Talhah to the daughter of Shabih bin Uthman, and all of them were in the state of ihram. Consequently, Aban, the son of Amir al-Mu'minin Sayyiduna Uthman bin Affan radi Allahu anhu, explained the correct ruling: that both performing a marriage contract (nikah) or having it performed for oneself while in the state of ihram are prohibited. This is also the position of the majority of scholars.
