Hadith 1551

حَدَّثَنَا عَبْدُ اللَّهِ بْنُ سَعِيدٍ، حَدَّثَنَا حَفْصٌ، حَدَّثَنَا عَبْدُ الرَّحْمَنِ بْنُ حُمَيْدِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ، عَنْ السَّائِبِ بْنِ يَزِيدَ، عَنْ الْعَلَاءِ بْنِ الْحَضْرَمِيِّ، قَالَ: "رَخَّصَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لِلْمُهَاجِرِينَ أَنْ يُقِيمُوا ثَلَاثًا بَعْدَ الصَّدَرِ بِمَكَّةَ" . قَالَ أَبُو مُحَمَّد: أَقُولُ بِهِ.
Sayyiduna Alaa bin Hadrami (may Allah be pleased with him) said: The Messenger of Allah (peace and blessings of Allah be upon him) allowed the Muhajirun to stay in Makkah for three days after Hajj before returning. Abu Muhammad Imam Darimi (may Allah have mercy on him) said: I also say the same.

Hadith Takhrij اس روایت کی سند صحیح ہے۔ تخریج اوپر گذر چکی ہے۔ امام دارمی رحمہ اللہ کا مقصد بھی ان احادیث کو ذکر کرنے کا یہ ہے کہ اگر تین دن تک مسافر کسی دوسرے شہر میں رہے تو وہ قصر کر سکتا ہے۔ واللہ اعلم۔
Brief Explanation
(Commentary on Hadith 1550)

Allamah Waheeduz-Zaman rahimahullah, while explaining this hadith, has written that what is meant by this is that those people who used to reside in Makkah and then, due to Islam, migrated from Makkah before the conquest of Makkah—if they come for Hajj or Umrah, then after completing their rites, they should not stay in Makkah for more than three days. And from this, the Shafi‘iyyah have deduced that a stay of three days does not, in reality, constitute residence (iqamah); rather, one who stays for three days is still considered a traveler (musafir). And if any traveler intends to stay for three days—apart from the day of arrival and the day of departure—then he is not considered a resident (muqim), but remains under the ruling of a traveler, and the concessions (rukhsah) for travelers are permissible for him, such as shortening the prayer (qasr) and breaking the fast (iftar) during Ramadan. End of his statement. In this hadith, “after al-sadr” means when the pilgrim has completed the rites (arkan) of Hajj.
