Hadith 2327

حَدَّثَنَا يُونُسُ بْنُ عَبْدِ الأَعْلَى ، حَدَّثَنَا ابْنُ وَهْبٍ ، أَخْبَرَنِي عَمْرُو بْنُ الْحَارِثِ ، وَهِشَامُ بْنُ سَعْدٍ ، عَنْ عَمْرِو بْنِ شُعَيْبٍ ، عَنْ أَبِيهِ ، عَنْ عَبْدِ اللَّهِ بْنِ عَمْرِو بْنِ الْعَاصِ ، أَنَّ رَجُلا مِنْ مُزَيْنَةَ أَتَى رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ: فَكَيْفَ تَرَى فِيمَا يُوجَدُ فِي الطَّرِيقِ الْمِيتَاءِ ، أَوْ فِي الْقَرْيَةِ الْمَسْكُونَةِ؟ قَالَ: " عَرِّفْهُ سَنَةً ، فَإِنْ جَاءَ بَاغِيهِ فَادْفَعْهُ إِلَيْهِ ، وَإِلا فَشَأْنُكَ بِهِ ، فَإِنْ جَاءَ طَالِبُهَا يَوْمًا مِنَ الدَّهْرِ ، فَأَدِّهَا إِلَيْهِ ، وَمَا كَانَ فِي الطَّرِيقِ غَيْرِ الْمِيتَاءِ ، وَالْقَرْيَةِ غَيْرِ الْمَسْكُونَةِ ، فَفِيهِ وَفِي الرِّكَازِ الْخُمْسُ " ،
It is narrated from Sayyiduna Abdullah bin Amr bin al-As (may Allah be pleased with him) that a man from the tribe of Muzaynah came to the Messenger of Allah (peace and blessings be upon him) and asked: "What do you say about something found in a populated road or inhabited settlement?" The Messenger of Allah (peace and blessings be upon him) said: "Announce it for one year, then if its owner comes, hand it over to him; otherwise, you may use it. Then, if its claimant comes at any time in your life, give it to him. And whatever wealth is found in a deserted road or uninhabited settlement, pay one-fifth (khums) as zakat from that wealth and from mines."
