Hadith 1291
حَدَّثَنَا
قُتَيْبَةُ، حَدَّثَنَا
حَمَّادُ بْنُ زَيْدٍ، عَنْ
عَمْرِو بْنِ دِينَارٍ، عَنْ
طَاوُسٍ، عَنْ
ابْنِ عَبَّاسٍ، أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " مَنِ ابْتَاعَ طَعَامًا فَلَا يَبِعْهُ حَتَّى يَسْتَوْفِيَهُ " . قَالَ ابْنُ عَبَّاسٍ : وَأَحْسِبُ كُلَّ شَيْءٍ مِثْلَهُ . قَالَ : وَفِي الْبَاب ، عَنْ جَابِرٍ ، وَابْنِ عُمَرَ ، وَأَبِي هُرَيْرَةَ . قَالَ أَبُو عِيسَى : حَدِيثُ ابْنِ عَبَّاسٍ حَدِيثٌ حَسَنٌ صَحِيحٌ ، وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَكْثَرِ أَهْلِ الْعِلْمِ ، كَرِهُوا بَيْعَ الطَّعَامِ ، حَتَّى يَقْبِضَهُ الْمُشْتَرِي ، وَقَدْ رَخَّصَ بَعْضُ أَهْلِ الْعِلْمِ فِيمَنِ ابْتَاعَ شَيْئًا مِمَّا لَا يُكَالُ وَلَا يُوزَنُ مِمَّا لَا يُؤْكَلُ ، وَلَا يُشْرَبُ ، أَنْ يَبِيعَهُ قَبْلَ أَنْ يَسْتَوْفِيَهُ ، وَإِنَّمَا التَّشْدِيدُ عِنْدَ أَهْلِ الْعِلْمِ فِي الطَّعَامِ ، وَهُوَ قَوْلُ : أَحْمَدَ ، وَإِسْحَاق .
Narrated by Abdullah bin Abbas (may Allah be pleased with them both): The Prophet (peace and blessings of Allah be upon him) said: “Whoever buys grain should not sell it until he has taken possession of it.” __QUR_N__ Ibn Abbas (may Allah be pleased with them both) said: I consider everything to be like grain in this regard. __XREF_N__ Imam Tirmidhi says:
1- The hadith of Ibn Abbas (may Allah be pleased with them both) is Hasan Sahih.
2- In this chapter, there are also ahadith from Jabir, Ibn Umar, and Abu Hurairah (may Allah be pleased with them all).
3- Most of the people of knowledge act upon this; they have declared it impermissible to sell grain until the buyer has taken possession of it.
4- And some of the people of knowledge have permitted selling before possession for one who buys something that is neither measured nor weighed, nor eaten or drunk.
5- According to the people of knowledge, the strictness is regarding grain. This is also the view of Ahmad and Ishaq bin Rahwayh. __REF_N__
Hadith 1298
'Abdullah bin Abbas (may Allah be pleased with them) says that the Messenger of Allah (peace and blessings of Allah be upon him) said: "An evil example is not suitable for us; the one who takes back a gift is like a dog that vomits and then licks it." 1.
Hadith 1299
قَالَ : وَفِي الْبَاب ، عَنْ ابْنِ عُمَرَ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، أَنَّهُ قَالَ : " لَا يَحِلُّ لِأَحَدٍ أَنْ يُعْطِيَ عَطِيَّةً ، فَيَرْجِعَ فِيهَا إِلَّا الْوَالِدَ فِيمَا يُعْطِي وَلَدَهُ " . حَدَّثَنَا بِذَلِكَ

حُسَيْنٍ الْمُعَلِّمِ، عَنْ
عَمْرِو بْنِ شُعَيْبٍ، أَنَّهُ سَمِعَ
طَاوُسًا يُحَدِّثُ ، عَنْ
ابْنِ عُمَرَ،
وَابْنِ عَبَّاسٍ يَرْفَعَانِ الْحَدِيثَ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِهَذَا الْحَدِيثِ . قَالَ أَبُو عِيسَى : حَدِيثُ ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُمَا حَدِيثٌ حَسَنٌ صَحِيحٌ ، وَالْعَمَلُ عَلَى هَذَا الْحَدِيثِ عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ ، قَالُوا : مَنْ وَهَبَ هِبَةً لِذِي رَحِمٍ مَحْرَمٍ ، فَلَيْسَ لَهُ أَنْ يَرْجِعَ فِيهَا ، وَمَنْ وَهَبَ هِبَةً لِغَيْرِ ذِي رَحِمٍ مَحْرَمٍ ، فَلَهُ أَنْ يَرْجِعَ فِيهَا ، مَا لَمْ يُثَبْ مِنْهَا ، وَهُوَ قَوْلُ : الثَّوْرِيِّ ، وقَالَ الشَّافِعِيُّ : لَا يَحِلُّ لِأَحَدٍ أَنْ يُعْطِيَ عَطِيَّةً فَيَرْجِعَ فِيهَا ، إِلَّا الْوَالِدَ فِيمَا يُعْطِي وَلَدَهُ . وَاحْتَجَّ الشَّافِعِيُّ بِحَدِيثِ عَبْدِ اللَّهِ بْنِ عُمَرَ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ : " لَا يَحِلُّ لِأَحَدٍ أَنْ يُعْطِيَ عَطِيَّةً ، فَيَرْجِعَ فِيهَا إِلَّا الْوَالِدَ فِيمَا يُعْطِي وَلَدَهُ " .
‘Abdullah bin ‘Umar and Ibn ‘Abbas (may Allah be pleased with them) narrated that the Prophet (peace and blessings of Allah be upon him) said: “It is not permissible for anyone to give a gift and then take it back, except for a father who gives something to his son.” © Imam Tirmidhi says:
1- The hadith of Ibn ‘Abbas (may Allah be pleased with them both) is Hasan Sahih.
2- Some of the people of knowledge among the Companions and others have acted upon this hadith. They say that if someone gives something as a gift to a close relative (mahram), then he does not have the right to take it back, but if he gives something as a gift to someone who is not a close relative (non-mahram), then it is permissible for him to take it back if he has not received compensation for it. This is also the saying of Thawri.
3- And Shafi’i says: It is not permissible for anyone to give a gift and then take it back, except for a father who gives something to his son. Shafi’i has used as evidence the hadith of ‘Abdullah bin ‘Umar (may Allah be pleased with them both), which he narrated from the Prophet (peace and blessings of Allah be upon him), that he said: “It is not permissible for anyone to give a gift and then take it back, except for a father who gives something to his son.”
Hadith 1311

ابْنِ أَبِي نَجِيحٍ، عَنْ
عَبْدِ اللَّهِ بْنِ كَثِيرٍ، عَنْ
أَبِي الْمِنْهَالِ، عَنْ
ابْنِ عَبَّاسٍ، قَالَ : قَدِمَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ الْمَدِينَةَ ، وَهُمْ يُسْلِفُونَ فِي الثَّمَرِ ، فَقَالَ : " مَنْ أَسْلَفَ ، فَلْيُسْلِفْ فِي كَيْلٍ مَعْلُومٍ ، وَوَزْنٍ مَعْلُومٍ إِلَى أَجَلٍ مَعْلُومٍ " . قَالَ : وَفِي الْبَاب ، عَنْ ابْنِ أَبِي أَوْفَى ، وَعَبْدِ الرَّحْمَنِ بْنِ أَبْزَى . قَالَ أَبُو عِيسَى : حَدِيثُ ابْنِ عَبَّاسٍ حَدِيثٌ حَسَنٌ صَحِيحٌ ، وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ ، أَجَازُوا السَّلَفَ فِي الطَّعَامِ ، وَالثِّيَابِ وَغَيْرِ ذَلِكَ ، مِمَّا يُعْرَفُ حَدُّهُ ، وَصِفَتُهُ ، وَاخْتَلَفُوا فِي السَّلَمِ فِي الْحَيَوَانِ ، فَرَأَى بَعْضُ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ ، السَّلَمَ فِي الْحَيَوَانِ جَائِزًا ، وَهُوَ قَوْلُ : الشَّافِعِيِّ ، وَأَحْمَدَ ، وَإِسْحَاق ، وَكَرِهَ بَعْضُ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ ، السَّلَمَ فِي الْحَيَوَانِ ، وَهُوَ قَوْلُ : سُفْيَانَ ، وَأَهْلِ الْكُوفَةِ ، أَبُو الْمِنْهَالِ اسْمُهُ عَبْدُ الرَّحْمَنِ بْنُ مُطْعِمٍ .
‘Abdullah bin ‘Abbas (may Allah be pleased with them) says that the Messenger of Allah (peace and blessings of Allah be upon him) came to Madinah and the people of Madinah used to practice salam (advance payment) in fruits, that is, they used to pay the price in advance. He said: “Whoever does salam should do so for a specified measure, a specified weight, and a specified period.” © Imam Tirmidhi says:
1- The hadith of Ibn ‘Abbas (may Allah be pleased with them) is hasan sahih.
2- In this chapter, ahadith have also been narrated from Ibn Abi Awfa and ‘Abdur Rahman bin Abza (may Allah be pleased with them).
3- The practice of the people of knowledge among the Companions and others is upon this. They consider it permissible to pay in advance for the purchase of grain, cloth, and things whose quantity and description are known.
4- There is a difference of opinion regarding paying in advance for the purchase of animals.
5- Some people of knowledge consider it permissible to pay in advance for the purchase of animals. This is also the saying of Shafi‘i, Ahmad, and Ishaq bin Rahwayh. And some of the people of knowledge among the Companions and others considered it disliked to pay in advance for the purchase of animals. This is the saying of Sufyan and the people of Kufah.
Hadith 1342
Ibn 'Abbas narrated that the Messenger of Allah (ﷺ) judged that the oath is due from the one the claim is made against.

ابْنِ عَبَّاسٍ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " الشَّرِيكُ شَفِيعٌ , وَالشُّفْعَةُ فِي كُلِّ شَيْءٍ " . قَالَ أَبُو عِيسَى : هَذَا حَدِيثٌ لَا نَعْرِفُهُ مِثْلَ هَذَا إِلَّا مِنْ حَدِيثِ أَبِي حَمْزَةَ السُّكَّرِيِّ , وَقَدْ رَوَى غَيْرُ وَاحِدٍ هَذَا الْحَدِيثَ , عَنْ عَبْدِ الْعَزِيزِ بْنِ رُفَيْعٍ , عَنْ ابْنِ أَبِي مُلَيْكَةَ , عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مُرْسَلًا وَهَذَا أَصَحُّ . حَدَّثَنَا

أَبُو بَكْرِ بْنُ عَيَّاشٍ، عَنْ
عَبْدِ الْعَزِيزِ بْنِ رُفَيْعٍ ,
وعَنِ ابْنِ أَبِي مُلَيْكَةَ , عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَحْوَهُ بِمَعْنَاهُ , وَلَيْسَ فِيهِ عَنْ ابْنِ عَبَّاسٍ , وَهَكَذَا رَوَى غَيْرُ وَاحِدٍ عَنْ عَبْدِ الْعَزِيزِ بْنِ رُفَيْعٍ , مِثْلَ هَذَا لَيْسَ فِيهِ عَنْ ابْنِ عَبَّاسٍ , وَهَذَا أَصَحُّ مِنْ حَدِيثِ أَبِي حَمْزَةَ , وَأَبُو حَمْزَةَ ثِقَةٌ , يُمْكِنُ أَنْ يَكُونَ الْخَطَأُ مِنْ غَيْرِ أَبِي حَمْزَةَ . حَدَّثَنَا

عَبْدِ الْعَزِيزِ بْنِ رُفَيْعٍ , عَنْ
ابْنِ أَبِي مُلَيْكَةَ , عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَحْوَ حَدِيثِ أَبِي بَكْرِ بْنِ عَيَّاشٍ , وقَالَ أَكْثَرُ أَهْلِ الْعِلْمِ : إِنَّمَا تَكُونُ الشُّفْعَةُ فِي الدُّورِ وَالْأَرَضِينَ , وَلَمْ يَرَوْا الشُّفْعَةَ فِي كُلِّ شَيْءٍ , وَقَالَ بَعْضُ أَهْلِ الْعِلْمِ : الشُّفْعَةُ فِي كُلِّ شَيْءٍ , وَالْقَوْلُ أَصَحُّ .
´Narrated Ibn Abbas:` that the Messenger of Allah (ﷺ) said: "The partner is the preemptor, and preemption is in everything."
Hadith 1385
حَدَّثَنَا
مَحْمُودُ بنُ غَيْلَانَ , أَخْبَرنَا
الْفَضْلُ بْنُ مُوسَى السِّينَانيُّ , أَخْبَرنَا
شَرِيك , عَنْ
شُعْبَةَ , عَنْ
عَمْرِو بْنِ دِينَارٍ , عَنْ
طَاوُسٍ , عَنِ
ابْنِ عَبَّاسٍ , " أن رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لَمْ يُحَرِّمْ الْمُزَارَعَةَ , وَلَكِنْ أَمَرَ أَنْ يَرفْقَ بَعْضُهُمْ بِبَعْضٍ " . قَالَ أَبُو عِيسَى : هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ , وحَدِيثٌ رَافِعٍ فِيِه اضْطِرابٌ , يُروى هَذَا الْحَدِيثٌ , عَنْ رَافِعِ بْنِ خَديِجٍ , عَنْ عُمُومَتِه , ويُروى عَنْهُ , عَنْ ظُهَيْرِ بْنِ رَافِعِ , وَهُوَ أَحَدُ عُمُومَتِه , وَقَدْ رَوَى هَذَا الْحَدِيثٌ عَنْه عَلَى رِوَايَاتٍ مُخْتَلِفَةٍ , وَفيِ الْبَاب : عَنْ زَيْدِ بْنِ ثَابِتٍ , وَجَابِرٍ رَضِى اللهُ عَنْهُمَا .
´Narrated Ibn 'Abbas:` "The Messenger of Allah (ﷺ) did not prohibit share-cropping. But he ordered that they be helpful with each other."
Hadith 1388
´Narrated 'Ikrimah:` from Ibn 'Abbas that the Prophet (ﷺ) made the blood-money twelve thousand.
Hadith 1391
حَدَّثَنَا
أَبُو عَمَّارٍ، حَدَّثَنَا
الْفَضْلُ بْنُ مُوسَى , عَنْ
الْحُسَيْنِ بْنِ وَاقِدٍ , عَنْ
يَزِيدَ بْنِ عَمْرٍو النَّحْوِيِّ , عَنْ
عِكْرِمَةَ , عَنْ
ابْنِ عَبَّاسٍ , قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " فِي دِيَةِ الْأَصَابِعِ , الْيَدَيْنِ وَالرِّجْلَيْنِ سَوَاءٌ , عَشْرٌ مِنَ الْإِبِلِ لِكُلِّ أُصْبُعٍ " . قَالَ أَبُو عِيسَى : وَفِي الْبَاب , عَنْ أَبِي مُوسَى , وَعَبْدِ اللَّهِ بْنِ عَمْرٍو . قَالَ أَبُو عِيسَى : حَدِيثُ ابْنِ عَبَّاسٍ حَدِيثٌ حَسَنٌ صَحِيحٌ غَرِيبٌ مِنْ هَذَا الْوَجْهِ , وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ وَبِهِ يَقُولُ سُفْيَانُ , وَالشَّافِعِيُّ , وَأَحْمَدُ , وَإِسْحَاق .
´Narrated Ibn 'Abbas:` that the Messenger of Allah (ﷺ) said: "The blood-money for the fingers on the hands and (the toes of) the feet is the same: Ten camels for each finger."
Hadith 1392
´Narrated Ibn 'Abbas:` that the Prophet (ﷺ) said: "These and these are the same." referring to the little finger and thumb.
Hadith 1401

إِسْمَاعِيل بْنِ مُسْلِمٍ , عَنْ

طَاوُسٍ , عَنْ
ابْنِ عَبَّاسٍ , عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " لَا تُقَامُ الْحُدُودُ فِي الْمَسَاجِدِ , وَلَا يُقْتَلُ الْوَالِدُ بِالْوَلَدِ " . قَالَ أَبُو عِيسَى : هَذَا حَدِيثٌ لَا نَعْرِفُهُ بِهَذَا الْإِسْنَادِ مَرْفُوعًا , إِلَّا مِنْ حَدِيثِ إِسْمَاعِيل بْنِ مُسْلِمٍ , وَإِسْمَاعِيل بْنُ مُسْلِمٍ الْمَكِّيُّ قَدْ تَكَلَّمَ فِيهِ بَعْضُ أَهْلِ الْعِلْمِ مِنْ قِبَلِ حِفْظِهِ .
´Narrated Ibn 'Abbas:` that the Prophet (ﷺ) said: 'The Hudud are not carried in the Masjid, and the father is not killed for the son."
Hadith 1404
حَدَّثَنَا
أَبُو كُرَيْبٍ، حَدَّثَنَا
يَحْيَى بْنُ آدَمَ , عَنْ
أَبِي بَكْرِ بْنِ عَيَّاشٍ، عَنْ
أَبِي سَعْدٍ، عَنْ
عِكْرِمَةَ , عَنْ
ابْنِ عَبَّاسٍ , " أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَدَى الْعَامِرِيَّيْنِ بِدِيَةِ الْمُسْلِمِينَ , وَكَانَ لَهُمَا عَهْدٌ مِنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " . قَالَ أَبُو عِيسَى : هَذَا حَدِيثٌ غَرِيبٌ , لَا نَعْرِفُهُ إِلَّا مِنْ هَذَا الْوَجْهِ , وَأَبُو سَعْدٍ الْبَقَّالُ اسْمُهُ : سَعِيدُ بْنُ الْمَرْزُبَانِ .
´Narrated Ibn 'Abbas:` "The Prophet (ﷺ) assigned the same blood-money for the two 'Amiris as that of the Muslims, and they had covenant from the Messenger of Allah (ﷺ)."
Hadith 1423

الْحَسَنِ الْبَصْرِيِّ , عَنْ
عَلِيٍّ، أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " رُفِعَ الْقَلَمُ عَنْ ثَلَاثَةٍ : عَنِ النَّائِمِ حَتَّى يَسْتَيْقِظَ , وَعَنِ الصَّبِيِّ حَتَّى يَشِبَّ , وَعَنِ الْمَعْتُوهِ حَتَّى يَعْقِلَ " . قَالَ : وَفِي الْبَاب , عَنْ عَائِشَةَ . قَالَ أَبُو عِيسَى : حَدِيثُ عَلِيٍّ حَدِيثٌ حَسَنٌ غَرِيبٌ مِنْ هَذَا الْوَجْهِ , وَقَدْ رُوِيَ مِنْ غَيْرِ وَجْهٍ , عَنْ عَلِيٍّ , عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، وَذَكَرَ بَعْضُهُمْ : وَعَنِ الْغُلَامِ حَتَّى يَحْتَلِمَ , وَلَا نَعْرِفُ لِلْحَسَنِ سَمَاعًا مِنْ عَلِيِّ بْنِ أَبِي طَالِبٍ , وَقَدْ رُوِيَ هَذَا الْحَدِيثُ عَنْ
عَطَاءِ بْنِ السَّائِبِ , عَنْ
أَبِي ظَبْيَانَ , عَنْ
عَلِيِّ بْنِ أَبِي طَالِبٍ , عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَحْوَ هَذَا الْحَدِيثِ , وَرَوَاهُ
الْأَعْمَشُ , عَنْ
أَبِي ظَبْيَانَ , عَنْ
ابْنِ عَبَّاسٍ , عَنْ
عَلِيٍّ , مَوْقُوفًا وَلَمْ يَرْفَعْهُ , وَالْعَمَلُ عَلَى هَذَا الْحَدِيثِ عِنْدَ أَهْلِ الْعِلْمِ , قَالَ أَبُو عِيسَى : قَدْ كَانَ الْحَسَنُ فِي زَمَانِ عَلِيٍّ وَقَدْ أَدْرَكَهُ , وَلَكِنَّا لَا نَعْرِفُ لَهُ سَمَاعًا مِنْهُ , وَأَبُو ظَبْيَانَ اسْمُهُ : حُصَيْنُ بْنُ جُنْدَبٍ .
´Narrated 'Ali:` That the Messenger of Allah (ﷺ) said: "The pen has been lifted from three; for the sleeping person until he awakens, for the boy until he becomes a young man and for the mentally insane until he regains sanity."
Hadith 1427

سَعِيدِ بْنِ جُبَيْرٍ , عَنْ
ابْنِ عَبَّاسٍ , أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ لِمَاعِزِ بْنِ مَالِكٍ : " أَحَقٌّ مَا بَلَغَنِي عَنْكَ ؟ " قَالَ : وَمَا بَلَغَكَ عَنِّي , قَالَ : " بَلَغَنِي أَنَّكَ وَقَعْتَ عَلَى جَارِيَةِ آلِ فُلَانٍ " , قَالَ : نَعَمْ , فَشَهِدَ أَرْبَعَ شَهَادَاتٍ , فَأَمَرَ بِهِ فَرُجِمَ . قَالَ : وَفِي الْبَاب , عَنْ السَّائِبِ بْنِ يَزِيدَ . قَالَ أَبُو عِيسَى : حَدِيثُ ابْنِ عَبَّاسٍ حَدِيثٌ حَسَنٌ , وَرَوَى
شُعْبَةُ، هَذَا الْحَدِيثَ , عَنْ
سِمَاكِ بْنِ حَرْبٍ , عَنْ
سَعِيدِ بْنِ جُبَيْرٍ مُرْسَلًا , وَلَمْ يَذْكُرْ فِيهِ عَنْ ابْنِ عَبَّاسٍ .
´Narrated Ibn 'Abbas:` That the Prophet (ﷺ) said to Ma'iz bin Malik: "Is what has reached me about you true?" He said: "What has reached you about me?" He said: "It has reached me that you had relations with the slave-maid of the family of so-and-so" He said: "Yes." So he testified four times, and he gave the order that he be stoned.

ابْنِ عَبَّاسٍ , عَنْ
عُمَرَ بْنِ الْخَطَّابِ , قَالَ : " إِنَّ اللَّهَ بَعَثَ مُحَمَّدًا صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِالْحَقِّ , وَأَنْزَلَ عَلَيْهِ الْكِتَابَ , فَكَانَ فِيمَا أَنْزَلَ عَلَيْهِ آيَةُ " الرَّجْمِ " , فَرَجَمَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ , وَرَجَمْنَا بَعْدَهُ , وَإِنِّي خَائِفٌ أَنْ يَطُولَ بِالنَّاسِ زَمَانٌ , فَيَقُولَ قَائِلٌ : لَا نَجِدُ الرَّجْمَ فِي كِتَابِ اللَّهِ , فَيَضِلُّوا بِتَرْكِ فَرِيضَةٍ أَنْزَلَهَا اللَّهُ , أَلَا وَإِنَّ الرَّجْمَ حَقٌّ عَلَى مَنْ زَنَى , إِذَا أَحْصَنَ وَقَامَتِ الْبَيِّنَةُ , أَوْ كَانَ حَبَلٌ أَوِ اعْتِرَافٌ " . وَفِي الْبَاب , عَنْ عَلِيٍّ . قَالَ أَبُو عِيسَى : هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ , وَرُوِيَ مِنْ غَيْرِ وَجْهٍ , عَنْ عُمَرَ رَضِيَ اللَّهُ عَنْهُ .
´'Umar bin Al-Khattab said:` "Verily Allah sent Muhammad (ﷺ) with the truth, and he revealed the Book to him. Among what was revealed to him was the Ayah of stoning. So the Messenger of Allah (ﷺ) stoned, and we stoned after him. I fear that time will pass over the people such that someone will say 'We do not see stoning in the Book of Allah.' They will be misguided by leaving an obligation which Allah revealed. Indeed stoning is the retribution for the adulterer if he was married and the evidence has been established, or due to pregnancy, or confession."
Hadith 1455

ابْنِ عَبَّاسٍ , قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " مَنْ وَجَدْتُمُوهُ وَقَعَ عَلَى بَهِيمَةٍ فَاقْتُلُوهُ وَاقْتُلُوا الْبَهِيمَةَ " , فَقِيلَ لِابْنِ عَبَّاسٍ : مَا شَأْنُ الْبَهِيمَةِ ؟ قَالَ : مَا سَمِعْتُ مِنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي ذَلِكَ شَيْئًا , وَلَكِنْ : " أَرَى رَسُولَ اللَّهِ كَرِهَ أَنْ يُؤْكَلَ مِنْ لَحْمِهَا , أَوْ يُنْتَفَعَ بِهَا , وَقَدْ عُمِلَ بِهَا ذَلِكَ الْعَمَلُ " , قَالَ أَبُو عِيسَى : هَذَا حَدِيثٌ لَا نَعْرِفُهُ إِلَّا مِنْ حَدِيثِ عَمْرِو بْنِ أَبِي عَمْرٍو , عَنْ عِكْرِمَةَ , عَنْ ابْنِ عَبَّاسٍ , عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ .
´Narrated Ibn 'Abbas:` That the Messenger of Allah (ﷺ) said: "Whomever you see having relations with an animal then kill him and kill animal." So it was said to Ibn 'Abbas: "What is the case of the animal?" He said: "I did not hear anything from the Messenger of Allah (ﷺ) about this, but I see that the Messenger of Allah (ﷺ) disliked eating its meat or using it, due to the fact that such a (heinous) thing has been done with that animal."
Hadith 1455
And Sufyan Thawri narrated via: «عاصم عن أبي رزين عن ابن عباس» (as a mawquf narration), he says: There is no prescribed punishment (hadd) for one who has intercourse with an animal («وطی»). This hadith was narrated to us by Muhammad bin Bashar with the chain «عبدالرحمٰن بن مهدي حدثنا سفيان الثوري», and it is more authentic than the first hadith 1؎.
2- The scholars act upon this 2؎, and this is also the opinion of Ahmad and Ishaq bin Rahwayh.

عَاصِمِ بْنِ عُمَرَ , عَنْ
سُهَيْلِ بْنِ أَبِي صَالِحٍ , عَنْ
أَبِيهِ , عَنْ
أَبِي هُرَيْرَةَ , عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ : " اقْتُلُوا الْفَاعِلَ وَالْمَفْعُولَ بِهِ " , قَالَ أَبُو عِيسَى : هَذَا حَدِيثٌ فِي إِسْنَادِهِ مَقَالٌ , وَلَا نَعْرِفُ أَحَدًا رَوَاهُ عَنْ سُهَيْلِ بْنِ أَبِي صَالِحٍ , غَيْرَ عَاصِمِ بْنِ عُمَرَ الْعُمَرِيِّ , وَعَاصِمُ بْنُ عُمَرَ يُضَعَّفُ فِي الْحَدِيثِ مِنْ قِبَلِ حِفْظِهِ , وَاخْتَلَفَ أَهْلُ الْعِلْمِ فِي حَدِّ اللُّوطِيِّ , فَرَأَى بَعْضُهُمْ أَنَّ عَلَيْهِ الرَّجْمَ أَحْصَنَ أَوْ لَمْ يُحْصِنْ , وَهَذَا قَوْلُ مَالِكٍ , وَالشَّافِعِيِّ , وَأَحْمَدَ , وَإِسْحَاق , وقَالَ بَعْضُ أَهْلِ الْعِلْمِ مِنْ فُقَهَاءِ التَّابِعِينَ مِنْهُمْ الْحَسَنُ الْبَصْرِيُّ , وَإِبْرَاهِيمُ النَّخَعِيُّ , وَعَطَاءُ بْنُ أَبِي رَبَاحٍ , وَغَيْرُهُمْ قَالُوا : حَدُّ اللُّوطِيِّ حَدُّ الزَّانِي , وَهُوَ قَوْلُ الثَّوْرِيِّ , وَأَهْلِ الْكُوفَةِ .
´Narrated Ibn 'Abbas:` That the Messenger of Allah (ﷺ) said: "Whomever you find doing the actions of the people of Lut then kill the one doing it, and the one it is done to."
Hadith 1458

عَبْدُ الْوَهَّابِ الثَّقَفِيُّ , حَدَّثَنَا
أَيُّوبُ , عَنْ
عِكْرِمَةَ , أَنَّ عَلِيًّا حَرَّقَ قَوْمًا ارْتَدُّوا عَنِ الْإِسْلَامِ , فَبَلَغَ ذَلِكَ
ابْنَ عَبَّاسٍ , فَقَالَ : لَوْ كُنْتُ أَنَا لَقَتَلْتُهُمْ , لِقَوْلِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " مَنْ بَدَّلَ دِينَهُ فَاقْتُلُوهُ " , وَلَمْ أَكُنْ لِأُحَرِّقَهُمْ , لِقَوْلِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " لَا تُعَذِّبُوا بِعَذَابِ اللَّهِ " , فَبَلَغَ ذَلِكَ
عَلِيًّا , فَقَالَ : صَدَقَ ابْنُ عَبَّاسٍ , قَالَ أَبُو عِيسَى : هَذَا حَدِيثٌ صَحِيحٌ حَسَنٌ , وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ فِي الْمُرْتَدِّ , وَاخْتَلَفُوا فِي الْمَرْأَةِ إِذَا ارْتَدَّتْ عَنِ الْإِسْلَامِ , فَقَالَتْ طَائِفَةٌ مِنْ أَهْلِ الْعِلْمِ : تُقْتَلُ , وَهُوَ قَوْلُ الْأَوْزَاعِيِّ , وَأَحْمَدَ , وَإِسْحَاق , وَقَالَتْ طَائِفَةٌ مِنْهُمْ : تُحْبَسُ , وَلَا تُقْتَلُ , وَهُوَ قَوْلُ سُفْيَانَ الثَّوْرِيِّ , وَغَيْرِهِ مِنْ أَهْلِ الْكُوفَةِ .
´Narrated 'Ikrimah:` That 'Ali burnt some people who apostasized from Islam. This news reached Ibn 'Abbas, so he said: "If it were me I would have killed them according to the statement of Messenger of Allah (ﷺ). The Messenger of Allah (ﷺ) said: 'Whoever changes his religion then kill him.' And I would not have burned them because the Messenger of Allah (ﷺ) said: 'Do not punish with the punishment of Allah.' So this reached 'Ali, and he said: "Ibn 'Abbas has told the truth."

دَاوُدَ بْنِ الْحُصَيْنِ , عَنْ
عِكْرِمَةَ , عَنْ
ابْنِ عَبَّاسٍ , عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ : " إِذَا قَالَ الرَّجُلُ لِلرَّجُلِ : يَا يَهُودِيُّ , فَاضْرِبُوهُ عِشْرِينَ , وَإِذَا قَالَ : يَا مُخَنَّثُ , فَاضْرِبُوهُ عِشْرِينَ , وَمَنْ وَقَعَ عَلَى ذَاتِ مَحْرَمٍ , فَاقْتُلُوهُ " , قَالَ أَبُو عِيسَى : هَذَا حَدِيثٌ لَا نَعْرِفُهُ إِلَّا مِنْ هَذَا الْوَجْهِ , وَإِبْرَاهِيمُ بْنُ إِسْمَاعِيل يُضَعَّفُ فِي الْحَدِيثِ ، وَقَدْ رُوِيَ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِنْ غَيْرِ وَجْهٍ رَوَاهُ الْبَرَاءُ بْنُ عَازِبٍ , وَقُرَّةُ بْنُ إِيَاسٍ الْمُزَنِيُّ , أَنَّ رَجُلًا تَزَوَّجَ امْرَأَةَ أَبِيهِ , فَأَمَرَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِقَتْلِهِ , وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَصْحَابِنَا , قَالُوا : مَنْ أَتَى ذَاتَ مَحْرَمٍ وَهُوَ يَعْلَمُ فَعَلَيْهِ الْقَتْلُ , وقَالَ أَحْمَدُ : مَنْ تَزَوَّجَ أُمَّهُ قُتِلَ , وقَالَ إِسْحَاق : مَنْ وَقَعَ عَلَى ذَاتِ مَحْرَمٍ قُتِلَ .
´Narrated Ibn 'Abbas:` That the Prophet (ﷺ) said: "If a man says to another man: 'O you Jew' then beat him twenty times. If he says: 'O you effeminate' then beat him twenty times. And whoever has relations with someone that is a Mahram then kill him."
Hadith 1475
´Narrated Ibn 'Abbas:` "The Messenger of Allah (ﷺ) prohibited taking a living thing as a shooting target."
Hadith 1501

الْفَضْلُ بْنُ مُوسَى , عَنْ
الْحُسَيْنِ بْنِ وَاقِدٍ , عَنْ
عِلْبَاءَ بْنِ أَحْمَرَ , عَنْ
عِكْرِمَةَ , عَنْ
ابْنِ عَبَّاسٍ , قَالَ : " كُنَّا مَعَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي سَفَرٍ , فَحَضَرَ الْأَضْحَى , فَاشْتَرَكْنَا فِي الْبَقَرَةِ سَبْعَةً , وَفِي الْبَعِيرِ عَشَرَةً " , قَالَ أَبُو عِيسَى : وَفِي الْبَاب , عَنْ أَبِي الْأَسَدِ السُّلَمِيِّ , عَنْ أَبِيهِ , عَنْ جَدِّهِ , وَأَبِي أَيُّوبَ , قَالَ أَبُو عِيسَى : حَدِيثُ ابْنِ عَبَّاسٍ حَدِيثٌ حَسَنٌ غَرِيبٌ , لَا نَعْرِفُهُ إِلَّا مِنْ حَدِيثِ الْفَضْلِ بْنِ مُوسَى .
´Narrated Ibn 'Abbas:` "We were with the Messenger of Allah (ﷺ) on a journey when the (Day of) Adha came, so we shared seven for a cow and ten for a camel."
Hadith 1546
´Narrated Ibn 'Abbas:` That Sa'd bin 'Ubadah asked the Messenger of Allah (ﷺ) about a vow that was due from his mother, who died before fulfilling it. The Prophet (ﷺ) said: "Fulfill it for her."
Hadith 1555
'Abdullah bin Abbas (may Allah be pleased with them both) says that the Messenger of Allah (peace and blessings of Allah be upon him) said: "The best companions are those whose number is four, and the best detachment is that whose number is four hundred, and the best army is that whose number is four thousand, and an Islamic army of twelve thousand will not be defeated due to small numbers." © Imam Tirmidhi says:
1- This hadith is Hasan Gharib,
2- Except for Jarir bin Hazim, no major hadith scholar has narrated this hadith with a connected chain; Zuhri has narrated it from the Prophet (peace and blessings of Allah be upon him) as Mursal,
4- This hadith has been narrated by Hibban bin Ali Al-Anzi with the chain «عقيل عن الزهري عن عبيد الله بن عبد الله عن ابن عباس عن النبي صلى الله عليه وسلم», and also by Laith bin Sa'd with the chain «عقيل عن الزهري عن النبي صلى الله عليه وسلم» as Mursal.
Hadith 1556

أَبِيهِ، عَنْ
يَزِيدَ بْنِ هُرْمُزَ، أَنَّ نَجْدَةَ الْحَرُورِيَّ ، كَتَبَ إِلَى
ابْنِ عَبَّاسٍ يَسْأَلُهُ : هَلْ كَانَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَغْزُو بِالنِّسَاءِ ؟ وَهَلْ كَانَ يَضْرِبُ لَهُنَّ بِسَهْمٍ ؟ فَكَتَبَ إِلَيْهِ ابْنُ عَبَّاسٍ ، كَتَبْتَ إِلَيَّ تَسْأَلُنِي : هَلْ كَانَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَغْزُو بِالنِّسَاءِ ؟ " وَكَانَ يَغْزُو بِهِنَّ ، فَيُدَاوِينَ الْمَرْضَى ، وَيُحْذَيْنَ مِنَ الْغَنِيمَةِ ، وَأَمَّا بِسَهْمٍ ، فَلَمْ يَضْرِبْ لَهُنَّ بِسَهْمٍ " ، وَفِي الْبَاب ، عَنْ أَنَسٍ ، وَأُمِّ عَطِيَّةَ ، وَهَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ ، وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَكْثَرِ أَهْلِ الْعِلْمِ ، وَهُوَ قَوْلُ سُفْيَانَ الثَّوْرِيِّ ، وَالشَّافِعِيِّ ، وقَالَ بَعْضُهُمْ : يُسْهَمُ لِلْمَرْأَةِ وَالصَّبِيِّ ، وَهُوَ قَوْلُ الْأَوْزَاعِيِّ ، قَالَ الْأَوْزَاعِيُّ : " وَأَسْهَمَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لِلصِّبْيَانِ بِخَيْبَرَ ، وَأَسْهَمَتْ أَئِمَّةُ الْمُسْلِمِينَ لِكُلِّ مَوْلُودٍ وُلِدَ فِي أَرْضِ الْحَرْبِ " ، قَالَ الْأَوْزَاعِيُّ : " وَأَسْهَمَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لِلنِّسَاءِ بِخَيْبَرَ ، وَأَخَذَ بِذَلِكَ الْمُسْلِمُونَ بَعْدَهُ " ، حَدَّثَنَا بِذَلِكَ عَلِيُّ بْنُ خَشْرَمٍ ، حَدَّثَنَا عِيسَى بْنُ يُونُسَ ، عَنْ الْأَوْزَاعِيِّ ، بِهَذَا ، وَمَعْنَى قَوْلِهِ : وَيُحْذَيْنَ مِنَ الْغَنِيمَةِ ، يَقُولُ : يُرْضَخُ لَهُنَّ بِشَيْءٍ مِنَ الْغَنِيمَةِ ، يُعْطَيْنَ شَيْئًا .
It is narrated from Yazid bin Hurmaz that Najdah bin Amir Haruri wrote to Ibn Abbas (may Allah be pleased with them both) asking: Did the Messenger of Allah (peace and blessings of Allah be upon him) take women along in jihad? And did he allocate a share of the spoils of war for them? Ibn Abbas (may Allah be pleased with them both) wrote back in reply: You have written to me asking: Did the Messenger of Allah (peace and blessings of Allah be upon him) take women along in jihad? Yes, he did take them along in jihad; they used to treat the sick, and they were given something from the spoils (as a reward), but as for a share, he did not allocate a share for them. © Imam Tirmidhi says:
1- This hadith is Hasan Sahih (good and authentic),
2- In this chapter, there are also ahadith from Anas and Umm Atiyyah (may Allah be pleased with them both).
3- Most of the scholars act upon this, and this is also the saying of Sufyan Thawri and Shafi’i. Some people say: A share should also be given to women and children; this is the saying of Awza’i.
4- Awza’i says: The Prophet (peace and blessings of Allah be upon him) gave a share to children at Khaybar, and the Muslim leaders allocated a share for every newborn who was born in the enemy’s land. Awza’i says: The Prophet (peace and blessings of Allah be upon him) gave a share to women at Khaybar, and after him, the Muslims continued to act upon this.

ابْنُ أَبِي الزِّنَادِ، عَنْ
أَبِيهِ، عَنْ
عُبَيْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ بْنِ عُتْبَةَ، عَنْ
ابْنِ عَبَّاسٍ، أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " تَنَفَّلَ سَيْفَهُ ذَا الْفَقَارِ يَوْمَ بَدْرٍ ، وَهُوَ الَّذِي رَأَى فِيهِ الرُّؤْيَا يَوْمَ أُحُدٍ " ، قَالَ أَبُو عِيسَى : هَذَا حَدِيثٌ حَسَنٌ غَرِيبٌ ، إِنَّمَا نَعْرِفُهُ مِنْ هَذَا الْوَجْهِ مِنْ حَدِيثِ ابْنِ أَبِي الزِّنَادِ ، وَقَدِ اخْتَلَفَ أَهْلُ الْعِلْمِ فِي النَّفَلِ مِنَ الْخُمُسِ ، فَقَالَ مَالِكُ بْنُ أَنَسٍ : لَمْ يَبْلُغْنِي أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَفَّلَ فِي مَغَازِيهِ كُلِّهَا ، وَقَدْ بَلَغَنِي أَنَّهُ نَفَّلَ فِي بَعْضِهَا ، وَإِنَّمَا ذَلِكَ عَلَى وَجْهِ الِاجْتِهَادِ مِنَ الْإِمَامِ فِي أَوَّلِ الْمَغْنَمِ وَآخِرِهِ ، قَالَ إِسْحَاقُ ابْنُ مَنْصُورٍ : قُلْتُ لِأَحْمَدَ : إِنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " نَفَّلَ إِذَا فَصَلَ بِالرُّبُعِ بَعْدَ الْخُمُسِ ، وَإِذَا قَفَلَ بِالثُّلُثِ بَعْدَ الْخُمُسِ " ، فَقَالَ : يُخْرِجُ الْخُمُسَ ثُمَّ يُنَفِّلُ مِمَّا بَقِيَ ، وَلَا يُجَاوِزُ هَذَا ، قَالَ أَبُو عِيسَى : وَهَذَا الْحَدِيثُ عَلَى مَا قَالَ ابْنُ الْمُسَيَّبِ : النَّفَلُ مِنَ الْخُمُسِ ، قَالَ إِسْحَاق : هُوَ كَمَا قَالَ .
´It is narrated from Abdullah bin Abbas that` on the day of Badr, the Prophet Muhammad (peace be upon him) took his sword Dhu al-Fiqar as a share from the spoils, and it was about this that he saw a dream on the day of Uhud 2. © Imam Tirmidhi says:
1- This hadith is Hasan Gharib; we know this hadith with this chain only from the narration of Ibn Abi Zinad,
2- There is a difference of opinion among the scholars regarding giving a share (nafl) from the khums. Malik bin Anas says: No narration has reached me that the Messenger of Allah (peace be upon him) gave a share (nafl) in all the battles; he gave a share in some battles, but this depends on the ijtihad of the Imam, whether he gives it at the beginning or at the end,
3- Ishaq bin Mansur says: I asked Ahmad bin Hanbal: Did the Prophet Muhammad (peace be upon him) give a quarter as nafl after taking out the khums at the time of departure, and a third as nafl after taking out the khums at the time of return? He said: He would take out the khums, then from what remained he would give nafl, and he would never exceed a third 3. This hadith is in accordance with the statement of Musayyib that nafl will be given from the khums. Ishaq bin Rahwayh has also said something similar.
Hadith 1570
Sa‘b bin Jathamah (may Allah be pleased with him) says: I submitted, “O Messenger of Allah! Our horses trampled over the women and children of the polytheists.” He replied, “They are also from their fathers.” 1© Imam Tirmidhi says: This hadith is hasan sahih.
Hadith 1574
'Umar bin Khattab (may Allah be pleased with him) narrates that it was said: "O Messenger of Allah! So-and-so man has been martyred." He replied: "Never! I saw him in the Hellfire because of the cloak (garment) which he had stolen from the spoils of war." He (the Prophet) said: "Umar! Stand up and announce three times that only believers will enter Paradise." (And a believer does not commit treachery.)

Hadith 1590
‘Abdullah bin ‘Abbas (may Allah be pleased with them) reports that the Messenger of Allah (peace and blessings of Allah be upon him) said on the day of the conquest of Makkah: “There is no migration after the conquest of Makkah, but jihad and intention remain. And when you are called for jihad, then set out.” 1. © Imam Tirmidhi says:
1- This hadith is hasan sahih.
2- Sufyan Thawri has also narrated a similar hadith from Mansur bin Mu’tamir.
3- In this chapter, ahadith have also been reported from Abu Sa‘id, ‘Abdullah bin ‘Amr, and ‘Abdullah bin Hubshi (may Allah be pleased with them).

A similar hadith is narrated from Ibn Abbas (may Allah be pleased with them both) through this chain as well.

Narrated from Abdullah bin Abbas (may Allah be pleased with them) that the Prophet Muhammad (peace and blessings be upon him) said to the delegation of Abdul Qais: "I command you to pay the khums (i.e., one-fifth) from the spoils of war." __REF_ Imam Tirmidhi says: There is a story in this hadith 1. __REF_ Imam Tirmidhi says: This hadith is Hasan Sahih.
Hadith 1639
‘Abdullah bin Abbas (may Allah be pleased with them) says: I heard the Messenger of Allah (peace and blessings of Allah be upon him) say: “Two eyes will not be touched by the fire of Hell: one eye that wept out of fear of Allah, and one eye that spent the night standing guard in the path of Allah.” © Imam Tirmidhi says:
1- The hadith of Ibn Abbas (may Allah be pleased with them) is Hasan Gharib; we know it only through the narration of Shu‘aib bin Riziq,
2- In this chapter, there are also ahadith from ‘Uthman and Abu Rayhanah (may Allah be pleased with them).

ابْنِ عَبَّاسٍ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ : " غَدْوَةٌ فِي سَبِيلِ اللَّهِ أَوْ رَوْحَةٌ خَيْرٌ مِنَ الدُّنْيَا وَمَا فِيهَا " ، قَالَ أَبُو عِيسَى : هَذَا حَدِيثٌ حَسَنٌ غَرِيبٌ ، وَأَبُو حَازِمٍ الَّذِي رَوَى عَنْ سَهْلِ بْنِ سَعْدٍ هُوَ أَبُو حَازِمٍ الزَّاهِدُ وَهُوَ مَدَنِيٌّ وَاسْمُهُ : سَلَمَةُ بْنُ دِينَارٍ ، وَأَبُو حَازِمٍ هَذَا الَّذِي رَوَى عَنْ أَبِي هُرَيْرَةَ هُوَ أَبُو حَازِمٍ الْأَشْجَعِيُّ الْكُوفِيُّ وَاسْمُهُ : سَلْمَانُ وَهُوَ مَوْلَى عَزَّةَ الْأَشْجَعِيَّةِ .
Narrated from Abu Hurairah (may Allah be pleased with him) and Abdullah bin Abbas (may Allah be pleased with them both) that the Prophet (peace and blessings of Allah be upon him) said: "A morning or an evening spent in jihad is better than the world and whatever is in it." © Imam Tirmidhi says:
1- This hadith is Hasan Gharib,
2- The Abu Hazim who narrated from Sahl bin Sa’d is Abu Hazim Zahid, a resident of Madinah, and his name is Salamah bin Dinar. And this Abu Hazim who narrated from Abu Hurairah is Abu Hazim Ashja’i, a resident of Kufa, his name is Salman, and he is the freed slave of Izzah Ashja’iyyah.
Hadith 1652

ابْنِ عَبَّاسٍ، أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ : " أَلَا أُخْبِرُكُمْ بِخَيْرِ النَّاسِ ؟ رَجُلٌ مُمْسِكٌ بِعِنَانِ فَرَسِهِ فِي سَبِيلِ اللَّهِ ، أَلَا أُخْبِرُكُمْ بِالَّذِي يَتْلُوهُ ؟ رَجُلٌ مُعْتَزِلٌ فِي غُنَيْمَةٍ لَهُ يُؤَدِّي حَقَّ اللَّهِ فِيهَا ، أَلَا أُخْبِرُكُمْ بِشَرِّ النَّاسِ ؟ رَجُلٌ يُسْأَلُ بِاللَّهِ وَلَا يُعْطِي بِهِ " ، قَالَ أَبُو عِيسَى : هَذَا حَدِيثٌ حَسَنٌ غَرِيبٌ مِنْ هَذَا الْوَجْهِ ، وَيُرْوَى هَذَا الْحَدِيثُ مِنْ غَيْرِ وَجْهٍ عَنْ ابْنِ عَبَّاسٍ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ .
Narrated from Abdullah bin Abbas (may Allah be pleased with them) that the Prophet Muhammad (peace and blessings be upon him) said: "Shall I not tell you about the best person among you? He is the one who holds the reins of his horse in the way of Allah. Shall I not tell you about the person who is next in rank to him? He is the one who, staying apart from people, lives among his goats and fulfills the rights of Allah. Shall I not tell you about the worst person? He is the one who, when asked in the name of Allah, does not give." © Imam Tirmidhi says:
1- This hadith is Hasan Gharib through this chain,
2- This hadith has come through several chains from Ibn Abbas (may Allah be pleased with them) in a marfu' manner.
Hadith 1672
Ibn Abbas (may Allah be pleased with them) says in the explanation of the noble verse: «أطيعوا الله وأطيعوا الرسول وأولي الأمر منكم» that the Messenger of Allah (peace and blessings of Allah be upon him) sent Abdullah bin Hudhafah bin Qais bin Adi Sahmi as a (single) commander of an expedition. 1
Hadith 1677
'Abdur Rahman bin Awf (may Allah be pleased with him) says that the Prophet Muhammad (peace and blessings of Allah be upon him) stationed us at appropriate places at Badr during the night. 1 __QUR_N__ Imam Tirmidhi says:
1- In this chapter, there is also a narration from Abu Ayyub. This hadith is gharib; we know it only through this chain.
2- I asked Muhammad bin Ismail Bukhari about this hadith: he expressed ignorance and said: The hearing of Muhammad bin Ishaq from Ikrimah is established, and when I met Bukhari, he had a good opinion about Muhammad bin Humaid al-Razi, but later he declared him weak.
Hadith 1681
'Abdullah bin Abbas (may Allah be pleased with them) says that the flag of the Messenger of Allah (peace and blessings of Allah be upon him) was black and the banner was white. © Imam Tirmidhi says:
This narration of Ibn Abbas with this chain is Hasan Gharib.
Hadith 1695
'Abdullah bin Abbas (may Allah be pleased with them) narrates that the Messenger of Allah (peace and blessings of Allah be upon him) said: "There is blessing in red-colored horses." © Imam Tirmidhi says: This hadith is hasan ghareeb; we know it from this chain only through the narration of Shayban.

عَبْدِ اللَّهِ بْنِ عُبَيْدِ اللَّهِ بْنِ عَبَّاسٍ، عَنْ
ابْنِ عَبَّاسٍ، قَالَ : كَانَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَبْدًا مَأْمُورًا ، مَا اخْتَصَّنَا دُونَ النَّاسِ بِشَيْءٍ إِلَّا بِثَلَاثٍ : " أَمَرَنَا أَنْ نُسْبِغَ الْوُضُوءَ ، وَأَنْ لَا نَأْكُلَ الصَّدَقَةَ ، وَأَنْ لَا نُنْزِيَ حِمَارًا عَلَى فَرَسٍ " ، قَالَ أَبُو عِيسَى : وَفِي الْبَاب ، عَنْ عَلِيٍّ ، وَهَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ ، وَرَوَى سُفْيَانُ الثَّوْرِيُّ هَذَا ، عَنْ أَبِي جَهْضَمٍ ، فَقَالَ : عَنْ عُبَيْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ بْنِ عَبَّاسٍ ، عَنْ ابْنِ عَبَّاسٍ ، قَالَ : وسَمِعْت مُحَمَّدًا ، يَقُولُ : حَدِيثُ الثَّوْرِيِّ غَيْرُ مَحْفُوظٍ وَوَهِمَ فِيهِ الثَّوْرِيُّ ، وَالصَّحِيحُ مَا رَوَى إِسْمَاعِيل ابْنُ عُلَيَّةَ ، وَعَبْدُ الْوَارِثِ بْنُ سَعِيدٍ ، عَنْ أَبِي جَهْضَمٍ ، عَنْ عَبْدِ اللَّهِ بْنِ عُبَيْدِ اللَّهِ بْنِ عَبَّاسٍ ، عَنْ ابْنِ عَبَّاسٍ .
‘Abdullah bin Abbas (may Allah be pleased with them both) says that the Messenger of Allah (peace and blessings of Allah be upon him) was a servant who acted according to Allah’s command and was commissioned by Him. He gave us three special instructions in comparison to others: He commanded us 1) to perform ablution completely, 2) not to eat charity, and 3) not to let a donkey loose among mares.
© Imam Tirmidhi says:
1- This hadith is Hasan Sahih.
2- Sufyan Thawri narrated from Abu Jahdam and mentioned the chain of this hadith as follows, «عن عبيد الله بن عبد الله بن عباس عن ابن عباس».
3- I heard Muhammad bin Ismail Bukhari say that Thawri’s narration is not preserved; there is a mistake from Thawri in it. The correct narration is the one reported by Ismail bin Ulayyah and Abdulwarith bin Sa’id from Abu Jahdam, Abu Jahdam from Abdullah bin Ubaydullah bin Abbas, and Ubaydullah from Ibn Abbas (may Allah be pleased with them both).
4- There is also a narration in this chapter from Ali (may Allah be pleased with him).
Hadith 1708
'Abdullah bin Abbas (may Allah be pleased with them) reports that the Messenger of Allah (peace and blessings of Allah be upon him) forbade making animals fight each other.
