It is narrated from Sa'id bin al-Musayyib, he used to say: When a pigeon of Makkah is killed, a goat becomes obligatory.
وَقَالَ مَالِك فِي الرَّجُلِ مِنْ أَهْلِ مَكَّةَ يُحْرِمُ بِالْحَجِّ أَوِ الْعُمْرَةِ، وَفِي بَيْتِهِ فِرَاخٌ مِنْ حَمَامِ مَكَّةَ، فَيُغْلَقُ عَلَيْهَا فَتَمُوتُ، فَقَالَ : أَرَى بِأَنْ يَفْدِيَ ذَلِكَ عَنْ كُلِّ فَرْخٍ بِشَاةٍ
Imam Malik, may Allah have mercy on him, said that if a person who lives in Makkah puts on the Ihram for Hajj or Umrah, and there is a nest of pigeon chicks in his house, and he closes the mouth of the nest and the chicks die, then for each chick he must give one goat.
قَالَ مَالِك : لَمْ أَزَلْ أَسْمَعُ أَنَّ فِي النَّعَامَةِ إِذَا قَتَلَهَا الْمُحْرِمُ بَدَنَةً
Imam Malik, may Allah have mercy on him, said: I have always heard that when an ostrich is killed by a muhrim, then a camel becomes obligatory.
قَالَ مَالِك : وَكُلُّ شَيْءٍ مِنَ النُّسُورِ، أَوِ الْعِقْبَانِ، أَوِ الْبُزَاةِ، أَوِ الرَّخَمِ، فَإِنَّهُ صَيْدٌ يُودَى، كَمَا يُودَى الصَّيْدُ، إِذَا قَتَلَهُ الْمُحْرِمُ
Imam Malik, may Allah have mercy on him, said: The vulture, the eagle, and the rakhm—all of these are game; if someone kills them, compensation will be required.
قَالَ مَالِك : وَكُلُّ شَيْءٍ فُدِيَ فَفِي صِغَارِهِ مِثْلُ مَا يَكُونُ فِي كِبَارِهِ، وَإِنَّمَا مَثَلُ ذَلِكَ مَثَلُ دِيَةِ الْحُرِّ الصَّغِيرِ وَالْكَبِيرِ فَهُمَا بِمَنْزِلَةٍ وَاحِدَةٍ سَوَاءٌ
Imam Malik, may Allah have mercy on him, said: The compensation for an animal remains the same as its prescribed recompense, whether the animal is small or large, just as the blood money for a minor and an adult is equal. That is, the compensation for a small deer is also one goat, and the compensation for a large deer is also one goat, just as if someone kills an adult man, the blood money is the same, and if someone kills a boy, the blood money is also the same.
قَالَ مَالِك : أَرَى أَنَّ فِي بَيْضَةِ النَّعَامَةِ عُشْرَ ثَمَنِ الْبَدَنَةِ، كَمَا يَكُونُ فِي جَنِينِ الْحُرَّةِ غُرَّةٌ عَبْدٌ أَوْ وَلِيدَةٌ، وَقِيمَةُ الْغُرَّةِ خَمْسُونَ دِينَارًا وَذَلِكَ عُشْرُ دِيَةِ أُمِّهِ .
Imam Malik, may Allah have mercy on him, said: In the case of an ostrich egg, one-tenth of the blood money for a camel is required, just as if someone kills the unborn child in the womb of a free woman, a slave man or woman must be given, whose value is fifty dinars, and fifty dinars is one-tenth of the total blood money.
