Hadith 790

وَحَدَّثَنِي ، عَنْ مَالِك ، عَنْ ابْنِ شِهَابٍ ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ " أَمَرَ بِقَتْلِ الْحَيَّاتِ فِي الْحَرَمِ "
It is narrated from Ibn Shihab that Sayyiduna Umar bin Khattab (may Allah be pleased with him) ordered the killing of snakes in the Haram.

Imam Malik (may Allah have mercy on him) said that by the biting dog, which has been ordered to be killed in the Haram, is meant any animal that bites people or attacks them, or frightens them, such as a lion, leopard, bear, and wolf; it is permissible to kill such an animal, and it is included among biting dogs. However, those beasts that do not attack, such as the badger, fox, and cat, and those similar to them, the muhrim should not kill them; if he does, then compensation will be obligatory upon him. Imam Malik (may Allah have mercy on him) said: The muhrim should not kill those beasts that cause harm, except those which the Messenger of Allah (peace and blessings be upon him) has named, the crow and the kite; if the muhrim kills any bird other than these two, then compensation will be obligatory upon him.
وَأَمَّا مَا ضَرَّ مِنَ الطَّيْرِ ، فَإِنَّ الْمُحْرِمَ لَا يَقْتُلُهُ إِلَّا مَا سَمَّى النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، الْغُرَابُ وَالْحِدَأَةُ وَإِنْ قَتَلَ الْمُحْرِمُ شَيْئًا مِنَ الطَّيْرِ سِوَاهُمَا فَدَاهُ
As for that which is harmful among the birds, the muhrim does not kill it except for what the Prophet, peace and blessings be upon him, named: the crow and the kite. And if the muhrim kills anything among the birds other than these two, he must offer a ransom.
قَالَ مَالِك فِي الْكَلْبِ الْعَقُورِ الَّذِي أُمِرَ بِقَتْلِهِ فِي الْحَرَمِ : إِنَّ كُلَّ مَا عَقَرَ النَّاسَ وَعَدَا عَلَيْهِمْ وَأَخَافَهُمْ ، مِثْلُ الْأَسَدِ وَالنَّمِرِ وَالْفَهْدِ وَالذِّئْبِ فَهُوَ الْكَلْبُ الْعَقُورُ ، وَأَمَّا مَا كَانَ مِنَ السِّبَاعِ لَا يَعْدُو مِثْلُ الضَّبُعِ وَالثَّعْلَبِ وَالْهِرِّ وَمَا أَشْبَهَهُنَّ مِنَ السِّبَاعِ فَلَا يَقْتُلُهُنَّ الْمُحْرِمُ ، فَإِنْ قَتَلَهُ فَدَاهُ
Malik said regarding the vicious dog that was commanded to be killed in the Haram: Indeed, everything that attacks people, assaults them, and frightens them, such as the lion, the tiger, the leopard, and the wolf, is the vicious dog. As for those beasts that do not attack, like the hyena, the fox, the cat, and those similar to them among the beasts, the muhrim does not kill them. If he kills one, he must pay a penalty.
