بَابُ الْقَضَاءِ فِي عِمَارَةِ الْمَوَاتِChapter of Judgement Regarding Reviving Dead Land
Hadith 1441
وَحَدَّثَنِي مَالِك، عَنْ ابْنِ شِهَابٍ ، عَنْ سَالِمِ بْنِ عَبْدِ اللَّهِ ، عَنْ أَبِيهِ ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ ، قَالَ : " مَنْ أَحْيَا أَرْضًا مَيِّتَةً، فَهِيَ لَهُ " . قَالَ مَالِك : وَعَلَى ذَلِكَ الْأَمْرُ عِنْدَنَا
It is narrated from Sayyiduna Abdullah bin Umar (may Allah be pleased with them) that Sayyiduna Umar (may Allah be pleased with him) said: Whoever cultivates barren land, it belongs to him.
Imam Malik (may Allah have mercy on him) said: In our view, this is the ruling.
