Hadith 1144

وَحَدَّثَنِي، عَنْ مَالِك، عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْقَاسِمِ، عَنْ أَبِيهِ، أَنَّ رَجُلًا مِنْ ثَقِيفٍ مَلَّكَ امْرَأَتَهُ أَمْرَهَا، فَقَالَتْ : أَنْتَ الطَّلَاقُ، فَسَكَتَ، ثُمّ قَالَتْ : أَنْتَ الطَّلَاقُ، فَقَالَ : بِفِيكِ الْحَجَرُ، ثُمّ قَالَتْ : أَنْتَ الطَّلَاقُ، فَقَالَ : بِفَيكِ الْحَجَرُ، فَاخْتَصَمَا إِلَى مَرْوَانَ بْنِ الْحَكَمِ، " فَاسْتَحْلَفَهُ مَا مَلَّكَهَا إِلَّا وَاحِدَةً، وَرَدَّهَا إِلَيْهِ " . قَالَ مَالِك : قَالَ عَبْدُ الرَّحْمَنِ : فَكَانَ الْقَاسِمُ يُعْجِبُهُ هَذَا الْقَضَاءُ، وَيَرَاهُ أَحْسَنَ مَا سَمِعَ فِي ذَلِكَ .
It is narrated from Qasim bin Muhammad that a man from the Thaqif tribe gave his wife the right to divorce herself. She gave herself one divorce; he remained silent. Then she gave herself a second divorce; he said, "May there be a stone in your mouth." She gave herself a third divorce; he said, "May there be a stone in your mouth." Then both of them, while arguing, came to Marwan. Marwan made him swear that he had given the right of only one divorce. After that, the woman was handed over to him.

Imam Malik, may Allah have mercy on him, said: Abdur Rahman used to say that Qasim bin Muhammad approved of this decision.
قَالَ مَالِك : وَهَذَا أَحْسَنُ مَا سَمِعْتُ فِي ذَلِكَ، وَأَحَبُّهُ إِلَيَّ
Imam Malik, may Allah have mercy on him, said: And I also like it very much.
