وَحَدَّثَنِي، عَنْ وَحَدَّثَنِي، عَنْ مَالِك، عَنْ
نَافِعٍ ، أَنَّ
عَبْدَ اللَّهِ بْنَ عُمَرَ ، كَانَ يَقُولُ :
" إِذَا مَلَّكَ الرَّجُلُ امْرَأَتَهُ أَمْرَهَا، فَالْقَضَاءُ مَا قَضَتْ بِهِ، إِلَّا أَنْ يُنْكِرَ عَلَيْهَا، وَيَقُولُ : لَمْ أُرِدْ إِلَّا وَاحِدَةً، فَيَحْلِفُ عَلَى ذَلِكَ، وَيَكُونُ أَمْلَكَ بِهَا مَا كَانَتْ فِي عِدَّتِهَا "
It is narrated from Nafi‘ that Sayyiduna Abdullah bin Umar (may Allah be pleased with them) used to say: When a man gives his wife the right to divorce herself, then whenever the woman wishes, she can take the divorce upon herself. However, if the husband denies and says: "I had given the right for only one divorce," and he swears an oath, then he will have the right to her as long as she is in her waiting period (‘iddah).
