بَابُ تَرْكِ أَكْلِ مَا قَتَلَ الْمِعْرَاضُ وَالْحَجَرُChapter on abstaining from eating what is killed by a blunt object or stone
Hadith 1040
وَحَدَّثَنِي، عَنْ مَالِكٍ، أَنَّهُ بَلَغَهُ، أَنَّ سَعِيدَ بْنَ الْمُسَيَّبِ، " كَانَ يَكْرَهُ أَنْ تُقْتَلَ الْإِنْسِيَّةُ بِمَا يُقْتَلُ بِهِ الصَّيْدُ مِنَ الرَّمْيِ وَأَشْبَاهِهِ " . قَالَ مَالِكٌ : وَلَا أَرَى بَأْسًا بِمَا أَصَابَ الْمِعْرَاضُ إِذَا خَسَقَ وَبَلَغَ الْمَقَاتِلَ أَنْ يُؤْكَلَ، قَالَ اللَّهُ تَبَارَكَ وَتَعَالَى : يَأَيُّهَا الَّذِينَ آمَنُوا لَيَبْلُوَنَّكُمُ اللَّهُ بِشَيْءٍ مِنَ الصَّيْدِ تَنَالُهُ أَيْدِيكُمْ وَرِمَاحُكُمْ سورة المائدة آية 94، قَالَ : فَكُلُّ شَيْءٍ نَالَهُ الْإِنْسَانُ بِيَدِهِ، أَوْ رُمْحِهِ، أَوْ بِشَيْءٍ مِنْ سِلَاحِهِ، فَأَنْفَذَهُ وَبَلَغَ مَقَاتِلَهُ، فَهُوَ صَيْدٌ، كَمَا قَالَ اللَّهُ تَعَالَى . وَحَدَّثَنِي، عَنْ مَالِكٍ، أَنَّهُ سَمِعَ أَهْلَ الْعِلْمِ، يَقُولُونَ : إِذَا أَصَابَ الرَّجُلُ الصَّيْدَ، فَأَعَانَهُ عَلَيْهِ غَيْرُهُ مِنْ مَاءٍ، أَوْ كَلْبٍ غَيْرِ مُعَلَّمٍ، لَمْ يُؤْكَلْ ذَلِكَ الصَّيْدُ، إِلَّا أَنْ يَكُونَ سَهْمُ الرَّامِي قَدْ قَتَلَهُ، أَوْ بَلَغَ مَقَاتِلَ الصَّيْدِ، حَتَّى لَا يَشُكَّ أَحَدٌ فِي أَنَّهُ هُوَ قَتَلَهُ، وَأَنَّهُ لَا يَكُونُ لِلصَّيْدِ حَيَاةٌ بَعْدَهُ، قَالَ : وَسَمِعْتُ مَالِكًا، يَقُولُ : لَا بَأْسَ بِأَكْلِ الصَّيْدِ وَإِنْ غَابَ عَنْكَ مَصْرَعُهُ، إِذَا وَجَدْتَ بِهِ أَثَرًا مِنْ كَلْبِكَ، أَوْ كَانَ بِهِ سَهْمُكَ، مَا لَمْ يَبِتْ، فَإِذَا بَاتَ فَإِنَّهُ يُكْرَهُ أَكْلُهُ
Hazrat Sa'id bin al-Musayyib considered it disliked to kill a startled animal in the manner that game is killed, such as with an arrow, etc.
Imam Malik, may Allah have mercy on him, said: If a stick has a pointed iron attached to it, and its point strikes the game and wounds it, then eating it is permissible.
Imam Malik, may Allah have mercy on him, said that Allah the Exalted has said: "O you who believe! Allah will surely test you with something of the game which your hands and your spears can reach." And whatever animal a person kills with his hands or his arrows is included in game.
Imam Malik, may Allah have mercy on him, said: I have heard from the people of knowledge, they used to say: If a person wounds game, and then the game suffers another injury, such as falling into water or being struck by an unknown dog, then it should not be eaten except in the case where it is certain that the animal died from the wound inflicted by the hunter. Imam Malik, may Allah have mercy on him, said: If the game, after being wounded, disappears and is then found with a mark of the hunting dog's wound or the hunter's arrow still in it, then eating it is permissible. However, if a night has passed over it, then eating it is disliked.
