Hadith 1599

أَخْبَرَنَا إِبْرَاهِيمُ، عَنْ صَالِحٍ مَوْلَى التَّوْءَمَةِ، عَنِ ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُ فِي قُطَّاعِ الطَّرِيقِ: إِذَا قَتَلُوا وَأَخَذُوا الْمَالَ قُتِّلُوا وَصُلِّبُوا، وَإِذَا قَتَلُوا وَلَمْ يَأْخُذُوا الْمَالَ قُتِّلُوا وَلَمْ يُصَلَّبُوا، وَإِذَا أَخَذُوا الْمَالَ وَلَمْ يَقْتُلُوا قُطِّعَتْ أَيْدِيهِمْ وَأَرْجُلُهُمْ مِنْ خِلَافٍ. وَإِذَا أَخَافُوا السَّبِيلَ وَلَمْ يَأْخُذُوا مَالًا نُفُوا مِنَ الْأَرْضِ.
It is narrated from Salih, the freed slave of Tuamah, that regarding bandits, Ibn Abbas (may Allah be pleased with him) said: When they commit murder and also loot wealth, they will be killed and crucified; and when they commit murder but do not loot wealth, they will be killed but not crucified; and when they loot wealth but do not commit murder, their hands and feet will be cut off from opposite sides; and when they only frighten travelers without looting wealth, they will be exiled.
