(حديث مرفوع) حَدَّثَنَا
عَبْدُ الرَّحْمَنِ ، عَنْ
سُفْيَانَ ، عَنْ
أَبِي قَيْسٍ ، عَنْ
هُزَيْلٍ ، قَالَ : جَاءَ رَجُلٌ إِلَى أَبِي مُوسَى ، وَسَلْمَانَ بْنِ رَبِيعَةَ ، فَسَأَلَهُمَا عَنِ ابْنَةٍ ، وَابْنَةِ ابْنٍ ، وأخت ، فقالا : للابنة النصف ، وللأخت النصف ، وأت عبد الله ، فإنه سيتابعنا ، فأتى
عبد الله ، فأخبره ، فقال : قد ضللت إذا وما أَنَا مِنَ الْمُهْتَدِينَ ، لَأَقْضِيَنَّ فِيهَا بِقَضَاءِ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، أَوْ قَالَ : قَضَاءَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ كَذَا قَالَ سُفْيَانُ : " لِلْابْنَةِ النِّصْفُ ، وَلِابْنَةِ الِابْنِ السُّدُسُ ، وَمَا بَقِيَ فَلِلْأُخْتِ " .
Huzail bin Shurahbeel says that once a man came to Sayyiduna Abu Musa (may Allah be pleased with him) and Sayyiduna Salman bin Rabee’ah (may Allah be pleased with him) and asked them this issue: If a person’s heirs include one daughter, one granddaughter, and one full sister, how will the inheritance be distributed? Both of them replied that half of the total wealth will go to the daughter and the other half to the sister, and you should also go to Sayyiduna Ibn Mas’ood (may Allah be pleased with him) and ask him this issue; he will agree with us and support us. So that man went to Sayyiduna Ibn Mas’ood (may Allah be pleased with him) and asked him the issue and also mentioned the answer given by the aforementioned gentlemen. Sayyiduna Ibn Mas’ood (may Allah be pleased with him) said: If I also give the same verdict, then I will go astray and will not remain among the guided ones. I will give the same decision that the Prophet (peace and blessings of Allah be upon him) gave: the daughter will get half of the total wealth, the granddaughter will get one-sixth so that two-thirds are completed, and whatever remains will go to the sister.
