حَدَّثَنَا هَاشِمٌ , حَدَّثَنَا لَيْثٌ , حَدَّثَنِي بْنُ شِهَابٍ , عَنْ سَعِيدِ بْنِ الْمُسَيَّبِ , عَنْ أَبِي هُرَيْرَةَ , أَنَّهُ قَالَ : " قَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي جَنِينِ امْرَأَةٍ مِنْ بَنِي لِحْيَانَ مِنْ هُذَيْلٍ , سَقَطَ مَيِّتًا , بِغُرَّةٍ عَبْدٍ أَوْ أَمَةٍ , ثُمَّ إِنَّ الْمَرْأَةَ الَّتِي قَضَى عَلَيْهَا بِالْغُرَّةِ تُوُفِّيَتْ , فَقَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِأَنَّ مِيرَاثَهَا لِبَنِيهَا وَزَوْجِهَا ، وَأَنَّ الْعَقْلَ عَلَى عَصَبَتِهَا " , حَدَّثَنَا إِسْحَاق بْنُ عِيسَى , حَدَّثَنَا لَيْثٌ , حَدَّثَنِي بْنُ شِهَابٍ , فَذَكَرَ مِثْلَهُ , إِلَّا أَنَّهُ قَالَ : ثُمَّ إِنَّ الْمَرْأَةَ الَّتِي قَضَى عَلَيْهَا بِالْغُرَّةِ تُوُفِّيَتْ .
It is narrated from Hazrat Abu Huraira (may Allah be pleased with him) that the Noble Prophet (peace and blessings be upon him) said: There was a dispute between two women of the tribe of Huzail. One of them struck the other, who was pregnant, with a stone and killed her, and the child in her womb was also born dead. The Noble Prophet (peace and blessings be upon him) gave the verdict of one "ghurra" (i.e., a male or female slave) in this matter. Then the woman against whom the verdict of "ghurra" was given passed away, so the Noble Prophet (peace and blessings be upon him) decided that her inheritance would go to her sons and husband, and the blood money would be upon her 'asaba (male relatives on the father's side).
