Hadith 39078
٣٩٠٧٨ - حدثنا ابن عيينة عن الزهري عن سالم عن أبيه عن النبي ﷺ قال: "من باع عبدا وله مال فماله للبائع إلا أن يشترط المبتاع" (١).
Hazrat Salim narrates from his father that the Holy Prophet, peace and blessings be upon him, said: Whoever sells a slave and that slave possesses some wealth, then this wealth will belong to the seller, unless it has been stipulated for the buyer.
Hadith 39079
٣٩٠٧٩ - حدثنا وكيع عن سفيان عن سلمة بن كهيل عمن سمع جابر بن عبد اللَّه يقول: قال رسول اللَّه ﷺ: "من باع عبدا وله مال فماله للبائع إلا أن يشترط المبتاع" (١).
Hazrat Jabir bin Abdullah (may Allah be pleased with him) narrates that the Messenger of Allah (peace and blessings be upon him) said: Whoever sells a slave and the slave possesses some wealth, then that wealth will belong to the seller, unless it has been stipulated for the buyer.
Hadith 39080
٣٩٠٨٠ - حدثنا حاتم بن إسماعيل عن جعفر عن أبيه قال: قال علي: من باع عبدا وله مال فماله للبائع إلا أن يشترط المبتاع، (قضى به رسول اللَّه ﷺ) (١) (٢).
Hazrat Ali (may Allah be pleased with him) says that whoever sells a slave and that slave has some property, then this property will belong to the seller. However, if a condition has been stipulated for the buyer regarding this property (then it will belong to the buyer). The Messenger of Allah (peace and blessings be upon him) gave this very ruling.
Hadith 39081
٣٩٠٨١ - حدثنا عبدة عن عبيد اللَّه عن نافع عن ابن عمر قال: قال رسول اللَّه ﷺ: " (من باع عبدا) (١) وله مال فماله لسيده إلا أن يشترط الذي اشتراه" (٢).
Hazrat Ibn Umar (may Allah be pleased with them) narrates that the Messenger of Allah (peace and blessings be upon him) said: Whoever sells a slave and that slave has some property, then that property will belong to his master. However, if that property was stipulated for the buyer, (then it will belong to the buyer).
Hadith 39082
٣٩٠٨٢ - حدثنا أبو الأحوص عن عبد العزيز بن رفيع عن عطاء وابن أبي مليكة قالا: قال رسول اللَّه ﷺ: "من باع عبدا فماله للبائع إلا أن يشترط المبتاع، يقول: اشتريه منك وماله" (١).
Hazrat Ata and Ibn Abi Mulaika narrate that the Messenger of Allah, peace and blessings be upon him, said: Whoever sells a slave, the slave’s property will belong to the seller, unless the buyer stipulates a condition (for example) says: I am buying this slave and his property from you. And (Imam) Abu Hanifa’s opinion has been mentioned that: If the slave’s property is more than the price (of the slave), then it is not permissible.
