Musannaf Ibn Abi Shaybah

Hazrat Ja'far bin Muhammad narrates from his father that the Holy Prophet (peace and blessings be upon him) gave a verdict based on one witness and an oath. The narrator says: And Ali (may Allah be pleased with him), the Chosen One, also gave a verdict before you on the same basis.

It is narrated from Hazrat Ibn Abbas (may Allah be pleased with them both) that the Noble Prophet (peace and blessings be upon him) gave a verdict based on one witness and an oath.

Hazrat Suwar relates about Hazrat Rabee’ah that I asked him regarding one witness and an oath. He replied: This matter was present in the letter of Hazrat Sa’d.

Hazrat Abu al-Zinad narrates that Umar bin Abdul Aziz wrote a letter to Abdul Hameed instructing him to judge on the basis of an oath along with a witness. Abu al-Zinad says that one of the elders or prominent figures among their elders informed me that Hazrat Shurayh also judged in this manner.

Hazrat Husain says that Abdullah bin Utbah gave a verdict against me based on one witness and one oath. And (Imam) Abu Hanifa's opinion has been mentioned that: this is not permissible.
