Hadith 39017
٣٩٠١٧ - حدثنا عبد اللَّه بن نمير عن ابن أبي ليلى عن الحكم قال: بعث النبي ﷺ معاذا وأمره أن يأخذ من كل ثلاثين تبيعا أو تبيعة، ومن كل أربعين مسنة، فسألوه عن فضل ما بينهما، فأبى أن يأخذ حتى سأل النبي ﷺ فقال: "لا تأخذ شيئا" (١).
It is narrated from Hazrat Hakam that the Holy Prophet (peace and blessings be upon him) sent Hazrat Mu'adh to Yemen and instructed him to take (for the collection of Zakat) one male or female tabi'ah (a one-year-old calf) for every thirty cows, and one two-year-old calf for every forty cows. When people asked him about what should be taken between these two amounts, he refused to take anything until he asked the Holy Prophet (peace and blessings be upon him). The Holy Prophet (peace and blessings be upon him) said: Do not take anything (between the two prescribed amounts).
Hadith 39018
٣٩٠١٨ - حدثنا عبد الأعلى عن داود بن أبي هند عن الشعبي قال: ليس (فيها) (١) شيء.
It is narrated from Hazrat Sha'bi that nothing is obligatory in excess amount.
Hadith 39019
٣٩٠١٩ - حدثنا غندر عن شعبة قال: سألت الحكم، قلت: إن كانت خمسين بقرة؟ قال الحكم: فيها مسنة.
Hazrat Shu’bah narrates that I asked Hakam: I said, “If there are fifty cows?” Hakam replied: “In that case also, it is a two-year-old calf.”
Hadith 39020
٣٩٠٢٠ - حدثنا عبد الرحيم عن محمد بن سالم عن الشعبي عن علي قال: ليس في النَّيِّف شيء (١).
Hazrat Ali (may Allah be pleased with him) said that nothing is obligatory on the excess amount.
Hadith 39021
٣٩٠٢١ - حدثنا ابن إدريس عن ليث عن طاوس أن معاذا قال: ليس في الأوقاص شيء (١).
Hazrat Mu'adh states that there is nothing obligatory on the amount between two nisabs. And (Imam) Abu Hanifa's opinion has been mentioned that: Zakat is also due on the excess amount.
