Musannaf Ibn Abi Shaybah

Hazrat Abu Huraira, Zaid bin Khalid, and Shibl narrate that they were present in the blessed service of the Holy Prophet (peace and blessings be upon him). A man stood up and said: I adjure you by Allah to judge between us according to the Book of Allah. (At that moment) the opponent of that man said: And he seemed more sensible than before. Please judge between us by the Book of Allah, and grant me permission to speak. The Prophet (peace and blessings be upon him) said: Speak! That man said: My son was working as a servant for him, and he committed adultery with his wife. So I gave a hundred sheep and a servant as compensation. Then I asked knowledgeable people, and I was told that my son’s punishment is a hundred lashes and one year of exile, and his wife’s punishment is stoning. The Holy Prophet (peace and blessings be upon him) said: “By Him in Whose hand is my soul, I will certainly judge between you according to the Book of Allah. The hundred sheep and the servant will be returned to you, and your son’s punishment is a hundred lashes and one year of exile.” And (he said), “O Anis! Go to this man’s wife, and if she confesses, then stone her.”

Hazrat Ubadah bin Samit narrates that the Noble Prophet (peace and blessings be upon him) said: Take this (command) from me; indeed Allah Almighty has made a way for women. If an unmarried woman commits adultery with an unmarried man, and a married man commits adultery with a married woman, then the virgin (unmarried ones) are to be punished with lashes and exile, and the married ones are to be punished with lashes and stoning. And (Imam) Abu Hanifa's opinion has been mentioned that: exile will not be carried out.
