Musannaf Ibn Abi Shaybah

Hazrat Zaid bin Khalid, Shibl, and Abu Hurairah narrate that we were present with the Noble Prophet (peace and blessings be upon him), when a man came to the Prophet (peace and blessings be upon him) and asked him about a married slave woman who committed adultery. The Prophet (peace and blessings be upon him) said: Flog her. Then if she commits the sin again, flog her again. The narrator says that then the Prophet (peace and blessings be upon him) said for the third and fourth time, then sell her even if it is in exchange for a rope.

It is narrated from Hazrat Ali (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: Establish the prescribed punishments (hudood) upon your male and female slaves.

Hazrat Abu Huraira narrates that the Noble Prophet (peace and blessings be upon him) said: When a slave-girl belonging to any of you commits adultery, the man (the owner) should flog her, but should not reproach her for the sin. Then if the slave-girl commits this sin again, the man should flog her again. Then if she commits this sin yet again, the owner should sell her, even if it is in exchange for a rope of hair.

It is narrated from Hazrat Aisha (may Allah be pleased with her) that the Noble Prophet (peace and blessings be upon him) said: When a slave-girl commits adultery, flog her; then if she commits this sin again, flog her again; then if she commits this sin again, flog her again; then if after that she commits this sin again, flog her and then sell her, even if it is in exchange for a rope.

Hazrat ‘Ubad bin Tamim narrates from his uncle, who was a participant in Badr, that the Noble Prophet (peace and blessings be upon him) said: When a slave-girl commits adultery, flog her; then if she commits adultery again, flog her; then if she commits adultery again, flog her; then sell her, even if it is in exchange for a rope. And (Imam) Abu Hanifa’s opinion has been mentioned that: The owner of the slave-girl will not flog the slave-girl.
