Hadith 35768
٣٥٧٦٨ - حدثنا جرير عن مغيرة عن إبراهيم قال: إذا أسر العدو رجلًا من المسلمين فاشتراه تاجر سعى للتاجر حتى يؤدي إليه ما اشتراه به، وإذا أسروا مملوكًا للمسلمين فاشتراه تاجر ثم وجده مولاه فهو أحق به بثمنه، وإذا اشتروا رجلًا من أهل الذمة سعى للتاجر حتى يؤدي إليه ثمنه.
Ibrahim (may Allah have mercy on him) says that if an enemy captures a Muslim and then a trader buys him, that person should try to pay the trader the price for which he was bought. And if the enemies capture slaves belonging to Muslims and then a trader buys them, then if their master finds them, he has more right to take them back by paying the price. And if they are bought from a dhimmi, then he should try to free himself by paying the trader the price.
Hadith 35769
٣٥٧٦٩ - حدثنا محمد بن بكر عن ابن جريج قال: قال عطاء في الحر يسبيه العدو ثم يشتريه المسلم مثل قوله في النساء.
Hazrat Ata (may Allah have mercy on him) regarding a free person who is captured by the enemy and then a Muslim buys him, says the same as was stated regarding women. And Hazrat Amr bin Dinar also says the same, meaning that the one who was bought by paying a price will pay that price to them.
Hadith 35771
٣٥٧٧١ - حدثنا غندر عن أبي معاذ عن أبي حريز أنه سمع الشعبي يقول: ما كان من أسارى في أيدي التجار فإن الحر لا يباع، فاردد إلى التاجر رأس مال.
Hazrat Sha'bi (may Allah have mercy on him) said that among the prisoners who are with the traders, whom they have bought and brought, those who are free should not be sold; the trader should be given back the original price.
