Musannaf Ibn Abi Shaybah

Hazrat Masawar Al-Warraq (may Allah have mercy on him) says that I asked Hazrat Sha'bi (may Allah have mercy on him) regarding a woman from among the dhimmis who was captured by the enemies, then the Muslims overpowered them and she came into the share of a Muslim woman; what is the ruling about her? Hazrat Sha'bi replied: Those with whom there is a covenant will be returned.

Ibrahim (may Allah have mercy on him) said that if the dhimmis are captured by the enemy and then the Muslims overpower them, those captives will not be considered slaves.

Hazrat Aamir (may Allah have mercy on him) says that dhimmis should not be sold.

Hazrat Aamir (may Allah have mercy on him) says that free persons who have been imprisoned should not be sold.

Hazrat Ghazirah al-Anbari (may Allah have mercy on him) narrates that we came to Hazrat Umar (may Allah be pleased with him). Hazrat Ibn Aun (may Allah have mercy on him) said: In any case, regarding women, or slave girls with whom adultery was committed during the time of ignorance, Hazrat Umar (may Allah be pleased with him) instructed their children that they would set a price upon their parents, and they would not be made (bondwomen).
