Hadith 35761
٣٥٧٦١ - حدثنا أبو داود الطيالسي عن أبي (حرة) (١) عن الحسن في رجل سبيت امرأته فافتداها زوجها من العدو تكون أمتَه؟ قال: لا.
It was asked from Hasan (may Allah have mercy on him) that if a man's wife was taken captive and then her husband paid ransom to free her from the enemy, would she be considered his slave-girl? He replied: No.
Hadith 35762
٣٥٧٦٢ - حدثنا محمد بن بكر عن ابن جريج قال: قلت لعطاء: نساء حرائر أصابهن العدو فابتاعهن رجل أيصيبهن؟ قال: لا، (ولا) (١) يسترقهن، ولكن ⦗٤٨٧⦘ يعطيهن أنفسهن بالذي أخذهن به، ولا (يزد) (٢) عليهن.
Hazrat Ibn Jurayj (may Allah have mercy on him) narrates that I asked Hazrat Ata (may Allah have mercy on him) if some free women are captured by the enemy and then someone buys them from them, can he have intercourse with them? He replied: No, and they will not become slave-girls either. Rather, the amount of money for which they were bought will be recovered from them, and no more than that amount will be taken.
