Hadith 35692
٣٥٦٩٢ - حدثنا عبد الرحيم بن سليمان عن محمد بن إسحاق عن الزهري عن سعيد بن المسيب عن جبير بن مطعم قال: قسم رسول اللَّه ﷺ سهم ذوي القربى على بني هاشم وبني المطلب (١).
It is narrated from Hazrat Jubair bin Mut'im that the Holy Prophet (peace be upon him) distributed the share of Dhul-Qurba among Banu Hashim and Banu Muttalib.
Hadith 35693
٣٥٦٩٣ - حدثنا عبد اللَّه بن نمير قال: ثنا هاشم بن (بريد) (١) قال: حدثني حسين بن ميمون عن عبد اللَّه بن عبد اللَّه عن عبد الرحمن بن أبي ليلى قال: سمعت عليًا يقول: قلت: يا رسول اللَّه إن رأيت أن (توليني) (٢) حقنا من الخمس في كتاب اللَّه، فاقسمه حياتك كي لا ينازعنيه أحد بعدك، قال: (نفعل) (٣) ذلك، قال: فولانيه رسول اللَّه ﷺ فقسمته حياة رسول اللَّه ﷺ، ثم ولانيه أبو بكر، فقسمته حياة أبي بكر، ثم ولانيه عمر، فقسمته حياة عمر، حتى كانت آخر سنة من (٤) سني عمر، فأتاه مال كثير فعزل حقنا، ثم أرسل إلي فقال: هذا حقكم فخذه فاقسمه حيث كنتَ تقسمه، فقلت: يا أمير المؤمنين، بنا عنه العام غنى وبالمسلمين إليه حاجة، فرده (عليه) (٥) تلك السنة، ثم لم يدعنا إليه أحد بعد عمر، حتى قمت مقامي هذا، فلقيت العباس بعد ما خرجت من عند عمر فقال: يا علي، لقد حرمتنا الغداة شيئا لا يُردّ علينا أبدا إلى يوم القيامة، وكان رجلًا (داهيا) (٦) (٧).
Hazrat Ali (may Allah be pleased with him) said: I submitted, O Messenger of Allah! If you deem it appropriate, appoint me as the guardian of our share from the khums of the Book of Allah, so that I may distribute it during your lifetime, so that after you, no one may dispute with me. He said that the Prophet (peace and blessings be upon him) did so and appointed me as its guardian. I distributed it during the lifetime of the Prophet (peace and blessings be upon him). Then Hazrat Abu Bakr Siddiq appointed me as the guardian, so I distributed it during the lifetime of Hazrat Abu Bakr Siddiq (may Allah be pleased with him). Then Hazrat Umar (may Allah be pleased with him) appointed me as the guardian, so I distributed it during the lifetime of Hazrat Umar (may Allah be pleased with him). Until the last year of the caliphate of Hazrat Umar (may Allah be pleased with him) arrived, a great amount of wealth came to him, he separated our right and sent it to me and said: This is your right, take it and distribute it wherever you wish. I submitted, O Commander of the Faithful (may Allah be pleased with him), we are in no need of it as the Muslims are in greater need of it. Thus, that year I returned it to him. After Hazrat Umar (may Allah be pleased with him), no one called us towards it until I am standing at this place. After leaving Hazrat Umar (may Allah be pleased with him), I met Hazrat Abbas (may Allah be pleased with him), he said: O Ali (may Allah be pleased with him), this morning you have deprived us of a thing (a right), now it will not be given to us until the Day of Judgment. And Hazrat Abbas (may Allah be pleased with him) was a man of sound opinion.
Hadith 35694
٣٥٦٩٤ - حدثنا عبد الرحيم بن سليمان عن محمد بن إسحاق عن الزهري ومحمد ابن علي عن يزيد بن هرمز: أن نجدة كتب إلى ابن عباس يسأله عن سهم ⦗٤٧٠⦘ ذوي القربى لمن هو؟ فكتب: كتبت تسألني عن سهم ذوي القربى لمن هو؟ فهو لنا، قال: إن عمر ابن الخطاب دعانا إلى أن تنكح منه (أيمنا) (١)، (ونخدم) (٢) منه عائلنًا، ونقضي منه عن غارمنا، فأبينا ذلك إلا أن يسلمه لنا جميعا فأبى أن يفعل فتركناه عليه (٣).
It is narrated from Hazrat Yazid bin Hurmaz that Najdah wrote to Hazrat Ibn Abbas (may Allah be pleased with them both) and asked him: For whom is the share of the near relatives (dhawi al-qurba)? Hazrat Ibn Abbas (may Allah be pleased with them both) wrote in reply: You have written to me asking for whom is the share of the near relatives? That share is for us. Then he said: Hazrat Umar bin Khattab (may Allah be pleased with him) invited us to use it for marrying off our unmarried women, for serving our family, and for paying off our creditors. We refused, except that all of it should be given to us. He refused to do so, so we left it for them.
Hadith 35695
٣٥٦٩٥ - حدثنا وكيع (قال: ثنا) (١) سفيان عن قيس بن مسلم عن الحسن بن محمد ابن الحنفية قال: اختلف الناس بعد وفاة النبي ﷺ في هذين السهمين سهم لرسول اللَّه ﷺ وسهم لذوي القربى، فقالت طائفة: سهم رسول اللَّه ﷺ للخليفة من بعده، وقالت طائفة: سهم (ذوي) (٢) القربى لقرابة الخليفة، فأجمعوا على أن يجعلوا هذين السهمين في الكراع وفي العدة في سبيل اللَّه (٣).
It is narrated from Hazrat Hasan bin Muhammad Ibn al-Hanafiyyah (may Allah have mercy on him) that after the demise of the Holy Prophet (peace and blessings be upon him), people differed regarding two portions: one was the portion of the Messenger of Allah ﷺ and the other was the portion of the near relatives (dhawi al-qurba). One group said: The portion of the Messenger of Allah ﷺ, after him, is for his successor (khalifah), and another group said: The portion of the near relatives is for the relatives of the khalifah. Then all the people agreed that both these portions would be spent on horses and preparation for jihad.
Hadith 35696
٣٥٦٩٦ - حدثنا وكيع عن حسن بن صالح عن عطاء بن السائب أن عمر بن عبد العزيز لما قام بعث بهذين السهمين سهم رسول اللَّه ﷺ، وسهم ذوي القربى -يعني لبني هاشم.
Hazrat Ata says that when Hazrat Umar bin Abdul Aziz became the caliph, he sent both of these portions (the portion of Allah's Messenger and the portion of the near relatives) to Banu Hashim.
Hadith 35697
٣٥٦٩٧ - حدثنا وكيع عن (الحسن) (١) عن السدي، ﴿وَلِذِي الْقُرْبَى﴾، قال: هم بنو عبد المطلب.
Hazrat Al-Suddi says that by the divine command { وَلِذِی الْقُرْبَی }, what is meant is the Banu Abd al-Muttalib.
Hadith 35698
٣٥٦٩٨ - حدثنا وكيع عن أبي معشر عن سعيد المقبري قال: كتب نجدة إلى ابن عباس يسأله عن سهم ذوي القربى فكتب إليه ابن عباس: إنا (كنا) (١) نزعم أنا (نحن) (٢) هم، فأبى ذلك علينا قومنا (٣).
It is narrated from Hazrat Saeed Al-Maqburi (may Allah have mercy on him) that Najdah wrote to Hazrat Ibn Abbas (may Allah be pleased with both of them) inquiring about the share of Dhul-Qurba. Hazrat Ibn Abbas (may Allah be pleased with both of them) wrote in reply: We believe that we are the ones (entitled to it), but our people have denied us.
Hadith 35699
٣٥٦٩٩ - حدثنا عبد الرحيم بن سليمان عن أشعث عن الحسن في هذه الآية: ﴿فَلِلَّهِ وَلِلرَّسُولِ وَلِذِي الْقُرْبَى وَالْيَتَامَى وَالْمَسَاكِينِ وَابْنِ السَّبِيلِ﴾ [الحشر: ٧]، قال: لم يعط أهلَ البيت بعد رسول اللَّه ﷺ الخمس: (أبو بكر) (١) ولا عمر ولا غيرهما، فكانوا يرون أن ذلك إلى الإمام (يضعه) (٢) في سبيل اللَّه وفي الفقراء حيث (أراه) (٣) اللَّه (٤).
Hasan (may Allah have mercy on him) said regarding the verse of the Noble Qur'an { لِلَّہِ وَلِلرَّسُولِ وَلِذِی الْقُرْبَی وَالْیَتَامَی وَالْمَسَاکِینِ وَابْنِ السَّبِیلِ } that after the passing of the Prophet (peace and blessings be upon him), Abu Bakr (may Allah be pleased with him) and Umar (may Allah be pleased with him) did not give the share to the Ahl al-Bayt. Their view was that this share is for the Imam, who will spend it in the way of Allah, and spend it among the poor wherever Allah guides him.
