الرجل يدخل بأمان فيقتل
Someone Comes Under Protection and Is Then Killed
Hadith 35666
٣٥٦٦٦ - حدثنا عبد اللَّه بن مبارك عن معمر عن زياد بن مسلم أن رجلًا من أهل (الهند) (١) (قدم) (٢) بأمانٍ (٣) (عدنَ) (٤) فقتله رجل من المسلمين بأخيه، فكتب في ذلك إلى عمر بن عبد العزيز، فكتب: أن لا تقتله، وخذ منه الدية، فابعث بها إلى ورثته، وأمر به فسجن.
It is narrated from Hazrat Ziyad bin Muslim that a person from the people of India came to Aden under protection, and a Muslim killed him. Regarding this, it was written to Hazrat Umar bin Abdul Aziz. He wrote: Do not kill him; take blood money from him and send that blood money to the heirs of the murdered person, and ordered that the killer be imprisoned.
Hadith 35667
٣٥٦٦٧ - حدثنا عبد الوهاب الثقفي عن حبيب المعلم عن الحسن أن رجلًا من المشركين حج، فلما رجع (صادرا) (١) لقيه رجل من المسلمين فقتله، فأمره النبي ﷺ أن (تؤدى) (٢) ديته إلى أهله (٣).
It is narrated from Hasan (may Allah have mercy on him) that a man from among the polytheists went for Hajj. When he returned, a Muslim killed him. The Messenger of Allah (peace and blessings be upon him) ordered (the killer) to pay blood money to his family.
Hadith 35668
٣٥٦٦٨ - حدثنا ابن مهدي عن سفيان عن يوسف بن يعقوب أن رجلًا من المشركين قتل رجلًا من المسلمين، ثم دخل بأمان فقتله أخوه، فقضى عليه عمر بن عبد العزيز بالدية وجعلها عليه في ماله، وحبسه في السجن وبعث بديته إلى ورثته من أهل الحرب.
It is narrated from Hazrat Yusuf bin Yaqub that a polytheist killed a Muslim, then he came under protection, so the brother of the murdered person killed him. Hazrat Umar bin Abdul Aziz decided upon blood money for this, made the blood money obligatory upon his wealth, had him imprisoned, and sent the blood money from his wealth to the heirs of the murdered person in the land of war.
