Musannaf Ibn Abi Shaybah

Hazrat Umar (may Allah be pleased with him) said that if any Muslim prisoner is in the custody of disbelievers, then his ransom will be paid from the Muslims’ treasury (Bait-ul-Mal).

It is narrated from Hazrat Bishr bin Ghalib that Hazrat Ibn Zubair (may Allah be pleased with them) asked Hazrat Hasan bin Ali (may Allah be pleased with him) that if a mujahid dhimmi is captured during jihad? He replied: His ransom will be paid from the tribute of those whom he fought against.

Ibrahim says that if the people of the covenant (dhimmis) are captured by the polytheists and then the Muslims overpower them, they will not be made slaves.
