Hadith 35182
٣٥١٨٢ - حدثنا (عثام) (١) بن علي عن الأعمش عن أبي إسحاق عن ابن مضرب قال: قسم عمر السواد بين أهل الكوفة، فأصاب كل رجل منهم ثلاثة فلاحين، فقال له عمر: فمن يكون لهم بعدهم، فتركهم (٢).
Hazrat Ibn Mudarrib (may Allah have mercy on him) narrates that Hazrat Umar (may Allah be pleased with him) distributed agricultural land among the people of Kufa in such a way that each person received three farmers. Upon this, Hazrat Umar (may Allah be pleased with him) said to them: What will these people get after this distribution? Then he (may Allah be pleased with him) left all of them.
Hadith 35183
٣٥١٨٣ - حدثنا ابن فضيل عن بيان عن قيس قال: كان (لبجيلة) (١) ربع السواد فقال عمر: لولا أني قاسم مسؤول ما زلتم على الذي قسم لكم (٢).
Hazrat Qais (may Allah have mercy on him) says that Bajila had a lot of land. Hazrat Umar (may Allah be pleased with him) said that if I were the one to distribute and supervise, you would have only what had been distributed among you.
Hadith 35184
٣٥١٨٤ - حدثنا ابن فضيل عن يحيى بن سعيد عن بشير بن يسار عن رجل من أصحاب النبي ﷺ أن النبي ﷺ حين ظهر على خيبر وصارت خيبر لرسول اللَّه ﷺ ⦗٣٢٩⦘ والمسلمين، ضعفوا من عملها، فدفعوها إلى اليهود (يعملونها وينفقون) (١) عليها على أن لهم نصف ما خرج منها، فقسمها رسول اللَّه ﷺ على ستة وثلاثين سهمًا، لكل سهم مائة سهم، فجعل رسول اللَّه ﷺ نصف ذلك كله، فكان في ذلك النصف سهام المسلمين، وسهم رسول اللَّه ﷺ معهم، وجعل النصف الآخر لمن ينزل به من الوفود والأمور ونوائب الناس (٢).
Hazrat Basheer bin Yasar (may Allah have mercy on him) narrates from a Companion (may Allah be pleased with him) that when the Noble Prophet (peace and blessings be upon him) conquered Khaybar and all of Khaybar became the property of the Messenger of Allah (peace and blessings be upon him) and the Muslims, the people became weary of working on it. So they gave these lands to the Jews so that they would work on them and spend on them, on the condition that half of the produce would go to them. And the Messenger of Allah (peace and blessings be upon him) divided it into thirty-six portions, each portion containing one hundred shares. Thus, the Messenger of Allah (peace and blessings be upon him) allocated half of all this specifically for the Muslims, in such a way that the Muslims had shares in this half, and along with them, the Messenger of Allah (peace and blessings be upon him) also had a share. And the other half, the Messenger of Allah (peace and blessings be upon him) allocated for the incoming delegations, other affairs, and for the hardships of the people.
Hadith 35185
٣٥١٨٥ - حدثنا وكيع قال: ثنا سفيان عن حبيب بن أبي ثابت عن أبي وائل قال: قال عمر: (لئن) (١) بقيت لآخذن فضل مال الأغنياء ولأقسمنه في فقراء المهاجرين (٢).
Hazrat Abu Wa'il narrates that Hazrat Umar (may Allah be pleased with him) said: If I remain alive, I will certainly take the surplus wealth from the rich and I will distribute it among the poor emigrants.
Hadith 35186
٣٥١٨٦ - حدثنا وكيع (قال) (١): ثنا سفيان عن واصل (الأحدب) (٢) عن أبي وائل قال: جلست إلى شيبة بن عثمان فقال لي: جلس عمر بن الخطاب مجلسك هذا فقال لي: لقد هممت أن لا أدع في الكعبة صفراء ولا بيضاء إلا (قسمتها) (٣) بين الناس قال: قلت له: ليس ذلك إليك، قد سبقك صاحباك فلم يفعلا ذلك، قال: هما (المرءان) (٤) يقتدى بهما (٥).
Hazrat Abu Wa'il (may Allah have mercy on him) narrates that I was sitting with Hazrat Shaiba bin Uthman (may Allah have mercy on him), so he said to me: Hazrat Umar bin Khattab (may Allah be pleased with him) was sitting in your place and said to me: Indeed, I intend that I will not leave any gold or silver in the Ka'bah except that I will distribute it among the people. I said to him: You (may Allah be pleased with you) do not have the authority to do this. Indeed, your two companions have passed away and neither of them did this. Hazrat Umar (may Allah be pleased with him) said: Yes, both of them are such personalities that they should be followed.
Hadith 35187
٣٥١٨٧ - حدثنا ابن إدريس عن مالك بن أنس عن زيد بن أسلم عن أسلم قال: سمعت عمر يقول: والذي نفس عمر بيده لولا أن يُترك آخر الناس لا شيء لهم ما افتتح على المسلمين قريةٌ من قرى الكفار إلا قسمتها سهمانا كما قسم رسول اللَّه ﷺ خيبر سهمانا، ولكن أردت أن يكون جِرْيَةً تجري عليهم، وكرهت أن يترك آخر الناس لا شيء لهم (١).
Hazrat Aslam (may Allah have mercy on him) narrates that I heard Hazrat Umar (may Allah be pleased with him) saying: "By the One in Whose hand is Umar's soul! If it were not for the fear that those who come after would be left with nothing and would have no share, then I would have divided all the settlements of the disbelievers that the Muslims have conquered into portions just as the Messenger of Allah (peace and blessings be upon him) divided Khaybar into portions. But I have decided that a stipend should be established for them, because I dislike that those who come after should be left with nothing at all."
Hadith 35188
٣٥١٨٨ - حدثنا وكيع قال: ثنا محمد بن عبد اللَّه الشعيثي عن ليث (أبي المتوكل) (١) عن مالك بن أوس بن الحدثان قال: سمعت عمر بن الخطاب يقول: ما من أحد من المسلمين إلا له في هذا الفيء نصيب إلا عبد مملوك، ولئن بقيت ليبلغن الراعي نصيبه من هذا الفيء في جبال صنعاء (٢).
Hazrat Malik bin Aws al-Hadathan (may Allah have mercy on him) narrates that I heard Hazrat Umar bin Khattab (may Allah be pleased with him) saying: Every Muslim has a share in this spoils of war, except for the slave, and if I remain alive, even the shepherd living in the mountains of Sana'a will surely receive his share from this spoils of war.
Hadith 35189
٣٥١٨٩ - حدثنا ابن عيينة عن عمرو بن دينار عن الزهري عن مالك بن أوس ابن الحدثان عن عمر قال: كانت أموال (١) بني النضير مما أفاء اللَّه على رسوله (٢) مما لم يُوجِف عليه المسلمون بخيل ولا ركاب، فكانت للنبي ﷺ خاصة، فكان يحبس منها نفقة سنة، وما بقي جعله في الكراع والسلاح عدة في سبيل اللَّه (٣).
Hazrat Malik bin Aws al-Hadthan (may Allah have mercy on him) narrates that Hazrat Umar (may Allah be pleased with him) said: The wealth of Banu Nadir which Allah granted to the Messenger of Allah (peace and blessings be upon him) was obtained by the Muslims without fighting; there was no need for combat in it. And this wealth was specific to the Noble Prophet (peace and blessings be upon him). He (peace and blessings be upon him) would set aside his yearly expenses from it, and whatever remained, he (peace and blessings be upon him) would allocate for horses and weapons, in preparation for using them in the path of Allah.
Hadith 35190
٣٥١٩٠ - حدثنا وكيع قال: ثنا هشام بن سعد عن زيد بن أسلم عن أبيه قال: أتي عمر بن الخطاب بغنائم من غنائم جلولاء فيها ذهب وفضة، فجعل يقسمهما بين الناس فجاء ابن له يقال له: عبد الرحمن فقال: يا (أمير) (١) المؤمنين اكسني خاتما، قال: اذهب إلى أمك تسقيك شربة من سويق، قال: فواللَّه ما أعطاه شيئًا (٢).
Hazrat Aslam (may Allah have mercy on him) narrates that spoils of war from the battle of Jalula were brought to Hazrat Umar bin Khattab (may Allah be pleased with him), among which there was also gold and silver. He (may Allah be pleased with him) was distributing it among the people when one of his sons, whose name was Abdur Rahman, came. He said: O Commander of the Faithful! Please let me wear a ring as well. He (may Allah be pleased with him) replied: Go to your mother, she will give you a drink of barley water! And he said: By Allah! I will not give him anything from it.
Hadith 35191
٣٥١٩١ - حدثنا عفان قال: ثنا عبد الواحد قال: ثنا أبو (طلق) (١) قال: (حدثنا) (٢) أبو حنظلة بن نعيم أن سعدا كتب إلى عمر: أنا أخذنا أرضا لم يقاتلنا أهلها، قال: فكتب إليه عمر إن شئتم أن تقسموها بينكم فاقسموها، وإن شئتم أن تدعوها فيعمرها أهلها ومن دخل فيكم بعد كان له فيها نصيب، فإني أخاف أن تشاحوا (فيها) (٣) وفي (شربها) (٤) فيقتل بعضكم بعضا، فكتب إليه سعد: أن المسلمين قد أجمعوا على أن رأيهم لرأيك (تبع) (٥)، فكتب إليه: أن يردوا الرقيق (إلا) (٦) امرأة حملت من رجل من المسلمين (٧).
Hazrat Abu Hanzala bin Naeem (may Allah have mercy on him) narrates that Hazrat Saad (may Allah have mercy on him) wrote a letter to Hazrat Umar (may Allah be pleased with him) saying that we have taken control of a region without fighting. What should we do now? Hazrat Umar (may Allah be pleased with him) replied to them in a letter: If you wish to divide this region among yourselves, then divide it, and if you wish, leave this region so that its inhabitants themselves will settle it. And if someone joins you in this region after you have received your share, then I fear that you will compete with each other in this matter and in the distribution of water, and then some of you will kill others. Hazrat Saad (may Allah have mercy on him) wrote a letter to him (may Allah be pleased with him) and said: Indeed, all the Muslims have agreed that their opinion is subject to your (may Allah be pleased with him) opinion. Hazrat Umar (may Allah be pleased with him) then wrote them a letter and said: Return the slaves to their women, even if any of them has become pregnant by a Muslim man.
