Hadith 35149
٣٥١٤٩ - حدثنا هشيم عن حصين أن رجلين من أهل (أُلَّيْس) (١) أسلما في عهد عمر قال: فأتيا عمر فأخبراه بإسلامهما فكتب لهما إلى عثمان بن حنيف أن يرفع الجزية عن رءوسهما ويأخذ الطسق من (أرضيهما) (٢) (٣).
Hazrat Husain (may Allah have mercy on him) narrates that two men from the people of Al-Yas accepted Islam during the time of Hazrat Umar (may Allah be pleased with him). So both of them came to Hazrat Umar (may Allah be pleased with him) and informed him about their acceptance of Islam. He (may Allah be pleased with him) wrote a letter regarding both of them to Hazrat Uthman bin Hunaif (may Allah have mercy on him) instructing him to exempt them from paying jizya, and to take only the land tax (kharaj) from their land.
Hadith 35150
٣٥١٥٠ - حدثنا هشيم عن سيار عن الزبير (بن) (١) عدي اليامي أن دهقانا أسلم على عهد علي، فقال (له) (٢) علي: إن أقصت في أرضك رفعنا الجزية عن رأسك وأخذناها (من أرضك) (٣)، وإن تحولت عنها فنحن أحق بها (٤).
Hazrat Zubair bin Adi al-Yami (may Allah have mercy on him) narrates that a landowner accepted Islam during the time of Hazrat Ali (may Allah be pleased with him). Hazrat Ali (may Allah be pleased with him) said to him: If you remain settled on your land, we will remove the jizya from you, and we will take ushr from your land. But if you move away from there, then we are more entitled to that land.
Hadith 35151
٣٥١٥١ - حدثنا حفص بن غياث عن محمد بن قيس عن أبي عون محمد بن عبيد اللَّه الثقفي عن عمر وعلي قالا: إذا أسلم وله أرض (وضعنا) (١) عنه الجزية وأخذنا خراجها (٢).
Hazrat Abu Awn Muhammad bin Ubaidullah Thaqafi (may Allah have mercy on him) narrates that Hazrat Umar (may Allah be pleased with him) and Hazrat Ali (may Allah be pleased with him), both of these noble companions, stated: When any dhimmi embraces Islam and he also owns some land, then we will remove the jizya from him and will collect the kharaj (land tax) on his land.
Hadith 35152
٣٥١٥٢ - [(حدثنا وكيع قال: ثنا سفيان عن) (١) قيس بن مسلم عن طارق بن شهاب أن دهقانة من أهل نهر الملك أسلمت، فقال عمر: ادفعوا إليها أرضها تؤدي عنها الخراج] (٢) (٣).
Hazrat Tariq bin Shihab (may Allah have mercy on him) narrates that a landowning woman from the people of Nahr al-Mulk accepted Islam. Hazrat Umar (may Allah be pleased with him) said: Return her land to her; she will pay its tax.
Hadith 35153
٣٥١٥٣ - حدثنا وكيع ثنا حسن بن صالح عن قيس بن مسلم عن طارق بن شهاب أن دهقانة أسلمت فكتب عمر أن خيروها (١).
Hazrat Qais bin Muslim (may Allah have mercy on him) narrates that Hazrat Tariq bin Shihab (may Allah have mercy on him) said: A landowning woman accepted Islam, so Hazrat Umar (may Allah be pleased with him) wrote a letter: Give this woman the opportunity to choose.
Hadith 35154
٣٥١٥٤ - حدثنا وكيع (١) ثنا سفيان عن جابر عن عامر أن الرفيل دهقان النهرين أسلم (ففرض) (٢) له عمر في ألفين، ورفع عن رأسه الجزية، ودفع إليه أرضه يؤدي عنها الخراج (٣).
Hazrat Aamir (may Allah be pleased with him) narrates that Rafiel, who was the landlord of Nahrain, accepted Islam. Hazrat Umar (may Allah be pleased with him) fixed a grant of two thousand for him, removed the jizya from his head, and returned his land to him on the condition that he would pay its kharaj.
Hadith 35155
٣٥١٥٥ - حدثنا حميد بن عبد الرحمن عن حسن عن منصور عن إبراهيم قال: إذا أسلم الرجل من أهل السواد ثم أقام بأرضه أخذ منه الخراج، فإن خرج منها لم يؤخذ منه الخراج.
Hazrat Mansur (may Allah have mercy on him) says that Ibrahim (may Allah have mercy on him) stated: When any person from among the people of the city accepted Islam and then remained residing in his land, then kharaj (land tax) was taken from him. If he left that place, then kharaj was not taken from him.
Hadith 35156
٣٥١٥٦ - حدثنا وكيع قال: ثنا محمد بن قيس عن عامر قال: لم يكن لأهل السواد عهد فلما رضوا منهم بالجزية صار لهم عهد.
Hazrat Muhammad bin Qais (may Allah have mercy on him) narrates that Hazrat Aamir (may Allah have mercy on him) said: There was no covenant for the people of the city; thus, if they agreed to pay jizya on their behalf, then that would be their agreement.
Hadith 35157
٣٥١٥٧ - [حدثنا وكيع قال: ثنا إسرائيل عن جابر عن عامر قال: ليس لأهل السواد عهد، إنما نزلوا على الحكم] (١).
Hazrat Jabir (may Allah have mercy on him) narrates that Hazrat Amir (may Allah have mercy on him) said: There is no covenant for the people of the city. Only those people will decide.
Hadith 35158
٣٥١٥٨ - حدثنا عبد اللَّه بن إدريس عن أشعث عن ابن سيرين قال: السواد بعضه صلح (وبعضه) (١) عنوة.
Hazrat Ash'ath (may Allah have mercy on him) narrates that Hazrat Ibn Sirin (may Allah have mercy on him) said: In a city, peace is made with some people and some are taken as captives.
Hadith 35159
٣٥١٥٩ - حدثنا وكيع عن عمران بن (حدير) (١) عن أبي مجلز قال: لما أسلم الهرمزان و (الفيرزان) (٢) قال (لهما) (٣) عمر: (إنما بكما) (٤) الجزية، إن الإسلام لحقيق أن يعيذ من الجزية (٥).
Hazrat Abu Majliz (may Allah have mercy on him) says that when Hormuzan and Firzan accepted Islam, Hazrat Umar (may Allah be pleased with him) said to both of them: "Indeed, jizya will be imposed upon you both, although the right of Islam is that it saves one from jizya."
