Musannaf Ibn Abi Shaybah

Hazrat Abu Amr al-Shaibani (may Allah have mercy on him) narrates that Mistawrid al-'Ajli, who had become an apostate, was brought to Hazrat Ali (may Allah be pleased with him). He (may Allah be pleased with him) presented Islam to him. He refused. So he (may Allah be pleased with him) had him killed. And his inheritance was distributed among his Muslim heirs.

Hazrat Hakam (may Allah have mercy on him) states that Hazrat Ali (may Allah be pleased with him) distributed the inheritance of an apostate among his Muslim heirs.

Hazrat Qasim bin Abdur Rahman (may Allah have mercy on him) narrates that Hazrat Abdullah bin Mas'ud (may Allah be pleased with him) said: When a person becomes an apostate, his son will be his heir.

Hazrat Jarir bin Hazim (may Allah have mercy on him) narrates that Hazrat Umar bin Abdul Aziz (may Allah have mercy on him) wrote a letter regarding the inheritance of an apostate as follows: I will certainly make the Muslims his heirs, and those of his (apostate's) religion will not receive anything.

Hazrat Abu al-Sabah (may Allah have mercy on him) narrates that I heard Hazrat Saeed bin al-Musayyib (may Allah have mercy on him) saying: "We will inherit from the apostate, but they will not inherit from us."

Hazrat Musa bin Abi Kathir (may Allah have mercy on him) says that I asked Hazrat Saeed bin Al-Musayyib (may Allah have mercy on him) about the inheritance of an apostate, whether it will be given? He (may Allah have mercy on him) replied: What do you mean by "will it be given"? The narrator says: I submitted, will his heirs inherit? He (may Allah have mercy on him) replied: We Muslims will inherit from him, but they (apostates) cannot inherit from us Muslims.

Hazrat Qatadah (may Allah have mercy on him) says that Hasan (may Allah have mercy on him) said: The apostate will be killed. And his inheritance will be distributed among the Muslim heirs.

Hazrat Ash'ath (may Allah have mercy on him) narrates that Hazrat Imam Sha'bi (may Allah have mercy on him) and Hazrat Hakam (may Allah have mercy on him), both of these personalities stated: The inheritance of an apostate will be distributed among his wife and his Muslim heirs.
