Musannaf Ibn Abi Shaybah

Hazrat Musa bin Abi Aisha (may Allah be pleased with her, may Allah have mercy on her) says that I asked Hazrat Murrah (may Allah have mercy on him) about a man who bought or captured a Magian woman and then had intercourse with her before teaching her Islam, so what is the ruling on this? He (may Allah have mercy on him) replied: This is not a correct action. And the narrator says: I asked Hazrat Saeed bin Jubair (may Allah have mercy on him), so he (may Allah have mercy on him) said: When he did such an act, he did not do good to her.

Hazrat Musa bin Abi Aisha (may Allah be pleased with her, may Allah have mercy on her) says that I asked Hazrat Murrah bin Shurahbil Al-Hamdani and Hazrat Saeed bin Jubair (may Allah have mercy on him) about a Magian slave girl: when a man keeps her, can he have intercourse with her? Hazrat Murrah said: He should not have intercourse with her until she accepts Islam. And Hazrat Saeed bin Jubair (may Allah have mercy on him) said: If he returns to her again, then this is a bad thing for him.

Hazrat Mak’hool (may Allah have mercy on him) says that when a girl is a Magian, do not marry her until she accepts Islam.

Imam Awza'i (may Allah have mercy on him) says that Hazrat Zuhri (may Allah have mercy on him) said: Do not go near a Magian until he says La ilaha illallah. So when he recites this, Islam will be assumed on his behalf.

Hazrat Simak (may Allah have mercy on him) narrates that Hazrat Abu Salamah bin Abdur Rahman (may Allah have mercy on him) said: Do not have intercourse with her until she accepts Islam.

Hazrat Hasan bin Muhammad (may Allah have mercy on him) narrates that the Messenger of Allah (peace and blessings be upon him) wrote a letter to the Magians of Hajr, inviting them to Islam. So, whoever among them accepted Islam, his Islam was accepted. And whoever refused, jizya was imposed upon him. Except that their slaughtered animals would not be eaten, and their women would not be married.

Yunus (may Allah have mercy on him) says that Hasan (may Allah have mercy on him) said regarding the man who has a Magian slave-girl: he should not have intercourse with her.

Hazrat Hammad (may Allah have mercy on him) says that Ibrahim (may Allah have mercy on him) stated: When Magian women or idolater women are captured, Islam will be presented to them and they will be compelled to accept Islam. If they accept Islam, then intercourse will be permitted with them and they will be made to serve. And if they refuse to accept Islam, then service will be taken from them but intercourse will not be permitted with them.

Hazrat Amr bin Shu'aib (may Allah have mercy on him) narrates that Hazrat Sa'id bin al-Musayyib (may Allah have mercy on him) said: There is no harm if a man buys a Magian slave-girl and has intercourse with her.
