Regarding Those Who Say That If an 'Asabah Is Closer to the Mother, the Wealth Goes to Him
Hadith 33708
٣٣٧٠٨ - حدثنا وكيع قال: ثنا الأعمش عن أبي وائل قال: كتب عمر إلى عبد اللَّه إذا كان أحد العصبة أقرب بأم فأعطه المال (١).
Abu Wa'il narrates that Hazrat Umar wrote to Hazrat Abdullah that when, in the 'Asabah, someone is closer to the mother, then give the wealth to him.
Hadith 33709
٣٣٧٠٩ - حدثنا وكيع قال: ثنا سفيان عن أبي إسحاق عن الحارث عن علي قال قضى رسول اللَّه ﷺ بالدين قبل الوصية وأنتم تقرأون: ﴿مِنْ بَعْدِ وَصِيَّةٍ يُوصِي بِهَا أَوْ دَيْنٍ﴾ [النساء: ١١]، وأن (أعيان) (١) (بني) (٢) الأم يتوارثون دون بني العلات، الإخوة من الأب والأم دون الإخوة من الأب (٣).
Harith narrates from Hazrat Ali (may Allah be pleased with him) that he said: The Messenger of Allah (peace and blessings be upon him) decreed that debt should be settled before the execution of a will, and you recite this verse: (min ba‘di wasiyyatin yūṣā bihā, aw daynin) __QUR_N__, and real brothers will be heirs, not those who share only the father.
Hadith 33710
٣٣٧١٠ - حدثنا وكيع قال: ثنا مالك بن (مغول) (١) قال: سألت الشعبي عن بني عم لأب وأم إلى ثلاثة، وعن بني عم لأب إلى اثنين فقال الشعبي: المال لبني العلات.
Malik bin Mighwal says that I asked Sha'bi about three full paternal cousins and two paternal half-cousins, so he replied that the wealth is for the paternal half-cousins.
Hadith 33711
٣٣٧١١ - حدثنا جرير عن منصور عن إبراهيم قال: قال عمر: إذا كانت العصبة أحدهم أقرب بأم، (فالمال له في الولاء) (١) (٢)
Ibrahim narrates that Hazrat Umar said: When, among the 'Asabah, someone is closer to the mother, then in wala', the wealth belongs to him.
