Regarding a Man Captured by the Enemy, Then a Relative Dies—Does He Inherit from Him?
Hadith 33609
٣٣٦٠٩ - حدثنا حفص بن غياث عن داود عن الشعبي عن شريح قال: أحوج ما يكون إلى ميراثه وهو أسير.
Shu'bi narrates that Hazrat Shurayh said: A person needs inheritance the most when he is in a state of imprisonment.
Hadith 33610
٣٣٦١٠ - حدثنا ابن مهدي عن هشام عن قتادة عن سعيد قال: يرث.
Qatadah narrates that Hazrat Saeed said: That person will be the heir.
Hadith 33611
٣٣٦١١ - حدثنا ابن مهدي عن هشام عن قتادة عن الحسن في ميراث الأسير قال: إنه لمحتاج إلى ميراثه.
Qatadah narrates from Hasan that the prisoner is dependent on the inheritance of his relative.
Hadith 33612
٣٣٦١٢ - حدثنا ابن مهدي عن سفيان عن ابن أبي ذئب عن الزهري قال: يرث الأسير.
Ibn Abi Dhi'b narrates that Zuhri said that a prisoner will be an heir.
Hadith 33613
٣٣٦١٣ - حدثنا ابن مهدي عن سفيان عمن سمع إبراهيم يقول: لا يرث الأسير.
Sufyan narrates from a man who heard Ibrahim say that a prisoner will not be an heir.
Hadith 33614
٣٣٦١٤ - حدثنا خالد بن الحارث عن سعيد عن قتادة عن سعيد بن المسيب في الأسير في أيدي العدو قال: لا يرث.
Qatadah narrates from Hazrat Saeed bin Musayyib regarding the captive who is in the possession of the enemies, he said that he will not be an heir.
Hadith 33615
٣٣٦١٥ - حدثنا عفان قال: ثنا وهيب عن داود عن سعيد بن المسيب أنه كان لا يورث الأسير.
Dawud says that Hazrat Saeed bin Musayyib did not make a captive an heir.
Hadith 33616
٣٣٦١٦ - حدثنا معن بن عيسى عن ابن أبي ذئب عن الزهري قال: يورث (مال) (١) الأسير وامرأته.
Ibn Abi Dhi'b narrates that Hazrat Zuhri said that the wealth of a prisoner and his wife will be distributed as inheritance.
