Hadith 33603
٣٣٦٠٣ - حدثنا حسين بن علي عن زائدة عن سماك عن (حنش) (١) قال: وقع رجل على وليدة، ثم باعها من آخر، فوقعا عليها فاجتمعا عليها في طهر واحد، فولدت غلامًا فأتوا عليًا، فقال علي: (يرثكما) (٢) وليس لأمه، وهو (للباقي) (٣) منكما بمنزلة أمه (٤).
Hanish narrates that a man had intercourse with an Umm Walad slave woman, then sold her to another man, and he also had intercourse with her. Thus, both had intercourse with her in the same period of purity. After that, she gave birth to a child. They brought this issue to Hazrat Ali (may Allah be pleased with him). Hazrat Ali (may Allah be pleased with him) said that the child will be the heir of both of you and will not belong to his mother, and whichever of you remains (survives), the child will be his, just as if he were his mother’s.
Hadith 33604
٣٣٦٠٤ - حدثنا (جرير) (١) عن مغيرة عن الشعبي قال: قضى علي في رجلين وطئا امرأة في طهر واحد، فولدت، فقضى أن جعله بينهما، يرثهما ويرثانه وهو (لأطولهما) (٢) حياة (٣).
Shu'bi narrates that Hazrat Ali (may Allah be pleased with him) gave a verdict regarding two men who had intercourse with a woman during the same period of purity, from which she bore a child, that the child should be divided between the two of them, in such a way that the child would be the heir of both, and both would be the heirs of the child, and the child would go to the one among them who lived longer.
Hadith 33605
٣٣٦٠٥ - حدثنا جرير عن مغيرة عن الشعبي قال: قضى عمر فيه بقول القافة (١).
Shu'bi narrates that regarding this child, Hazrat Umar (may Allah be pleased with him) gave a verdict according to the statement of the physiognomists.
Hadith 33606
٣٣٦٠٦ - حدثنا جرير عن منصور عن إبراهيم قال: دعا عمر (أمة) (١) فسألها من أيهما هو؟ فقالت: ما أدري وقعا علي في طهر، فجعله عمر بينهما (٢).
Ibrahim narrates that Hazrat Umar (may Allah be pleased with him) called the slave woman and asked her, "Whose child is this among the two?" She replied, "I do not know; both of them had intercourse with me in the same period of purity." So Hazrat Umar (may Allah be pleased with him) divided the child between the two of them.
Hadith 33607
٣٣٦٠٧ - حدثنا علي بن مسهر عن الأجلح عن الشعبي عن عبد اللَّه بن (١) الحضرمي عن زيد بن أرقم قال: بينا نحن عند رسول اللَّه ﷺ إذ أتاه رجل من اليمن وعلي بها، فجعل (يحدث) (٢) النبي ﷺ ويخبره، قال: يا رسول اللَّه ﷺ، أتى عليًا ثلاثة نفر فاختصموا في ولد، كلهم (٣) زعم أنه ابنه وقعوا على امرأة في طهر واحد، فقال علي: إنكم شركاء متشاكسون، وإني مقرع بينكم، فمن قرع فله الولد، وعليه ثلثا الدية (لصاحبيه) (٤)، قال: فأقرع بينهم، فقرع أحدهم، فدفع إليه الولد، وجعل عليه ثلثي الدية، فضحك رسول اللَّه ﷺ حتى بدت نواجذه أو أضراسه (٥).
Zaid bin Arqam (may Allah be pleased with him) said: We were with the Messenger of Allah (peace and blessings of Allah be upon him) when a man from Yemen came, while Ali (may Allah be pleased with him) was still in Yemen, and he began to inform the Prophet (peace and blessings be upon him) of matters and news. He said: O Messenger of Allah! Three men came to Ali (may Allah be pleased with him) and began to dispute over a boy; each of them claimed that he was his son, while they had all had intercourse with a woman during the same period of purity. Ali (may Allah be pleased with him) said: You are equal partners, and I will draw lots among you; whoever's name is drawn, the boy will be his, and he will be required to pay two-thirds of the blood money to the other two companions. He said: Then he drew lots among them, and gave the boy to the one whose name was drawn, and made him liable for two-thirds of the blood money. At this, the Prophet (peace and blessings be upon him) laughed so much that his back teeth or his molars became visible.
Hadith 33608
٣٣٦٠٨ - حدثنا أبو أسامة عن هشام بن عروة عن أبيه عن يحيى بن عبد الرحمن بن حاطب عن أبيه أن عمر قضى في رجلين ادعيا رجلًا لا يدرى أيهما أبوه، فقال عمر: للرجل اتبع أيهما شئت (١).
Abdur Rahman bin Hatib narrates that Hazrat Umar (may Allah be pleased with him) gave a verdict regarding two men who claimed the lineage of an unknown parentage man, and he said to that man of unknown parentage, "Go with whichever of the two you wish."
