Musannaf Ibn Abi Shaybah

Qasim bin Abdur Rahman narrates that Hazrat Abdullah (may Allah be pleased with him) said: When a person becomes an apostate, his children will inherit from him.

Abu Amr Shaibani narrates that Mistawrid Ajli, who had become an apostate, was brought to Hazrat Ali (may Allah be pleased with him). He presented Islam to him, but he refused, so he had him killed and distributed his inheritance among his Muslim heirs.

Hakam narrates that Hazrat Ali (may Allah be pleased with him) said regarding the inheritance of an apostate that it should be given to his Muslim heirs.

Jarir bin Hazim narrates that Umar bin Abdul Aziz, may Allah have mercy on him, wrote regarding the inheritance of an apostate that it will be for his Muslim heirs, and nothing will be for his co-religionists.

Qatadah narrates that Hasan said: The apostate will be killed and his inheritance will go to his Muslim heirs.

Amr narrates that Hasan gave the inheritance of the apostate to his heirs.

Musa bin Abi Kathir says that I asked Saeed bin Musayyib about the inheritance of an apostate, whether it will be joined? He asked, "What do you mean by joining?" I said, "Will their sons inherit from him?" He replied, "We will be their heirs, and they will not be our heirs."

Musa bin Abi Kathir narrates that I heard Hazrat Saeed bin Musayyib saying: "We will inherit from the apostates, but they will not inherit from us."

Ash'ath narrates that Shu'bi and Hakam said: The inheritance of an apostate will be distributed among his Muslim wife and Muslim heirs.

Hazrat Waki' says that I heard Hazrat Sufyan say: If a murtad (apostate) goes to Dar al-Harb, then the inheritance is distributed, and before his umm walad and mudabbirah are freed, he returns, then he alone is entitled to them.

Amr narrates that Hasan said, the Muslims used to consider the inheritance of an apostate lawful, that is, when he is killed.
