Musannaf Ibn Abi Shaybah

Abu Al-Minhal narrates that Hazrat Iyas bin Abd Muzani was asked about those people upon whom a house collapsed and they all died; he replied that they are heirs to one another.

Qatan bin Abdullah Dhabbi narrates that a woman traveled to the Euphrates along with her son, and both of them drowned, and it was not known which of them died before the other. We went to Hazrat Shurayh and informed him of this. He said: Make each of them the heir of the other, and do not return to either of them the wealth which he or she inherited from the other.

Amr bin Amr al-Jushami narrates that Abdullah bin Utbah, who was a judge during the time of Ibn Zubair, declared those who drowned together to be heirs of one another.

Simak narrates from a man from Hazrat Umar (may Allah be pleased with him) that he made those who had drowned heirs of one another.

Abu Hasin narrates that some people drowned from the bridge of the city of Manbij, so Hazrat Umar (may Allah be pleased with him) made them heirs of one another. Sufyan says that I asked Abu Hasin, "Did you hear this from Hazrat Sha'bi?" He replied, "Yes!"

Harith narrates that when a family drowned while traveling in a boat, Hazrat Ali (may Allah be pleased with him) made them heirs of one another.

‘Ubaidah says that a house collapsed on some people or some people died in a plague, so Hazrat Umar (may Allah be pleased with him) made them heirs of one another.

Haris Bajali narrates from his father that a father and son or two brothers were killed together in the battle of Siffin, and it could not be determined who was killed first. So, Hazrat Ali (may Allah be pleased with him) made each of them the heir of the other.

Qabeesah bin Dhu’ayb says that a plague broke out in Syria, so much so that in some households, every single member would die. Hazrat Umar (may Allah be pleased with him) wrote that the one above should be made the heir of the one below, and if that is not possible, then they should be made heirs of one another. Sa’eed says that the meaning of making the one above the heir of the one below is that among them, the one who died would die in such a way that his hand would be placed on the side of the other.

Qatadah narrates that the same meaning has been reported from Hazrat Ali (may Allah be pleased with him).

Mansur narrates that Ibrahim says regarding those people who die in such a way that it is not known who died first among them, that they should be made heirs of one another. Hazrat Mansur says that there is no harm in starting with whichever of them you wish when making them heirs of one another.
