Hadith 33369
٣٣٣٦٩ - حدثنا ابن فضيل عن بسام عن فضيل قال: قال إبراهيم: في امرأة تركت زوجها وأمها وأخاها لأبيها وجدها، للزوج النصف ثلاثة أسهم، وللأم الثلث سهمان، وللجد سهم في قول علي وزيد، وفي قول عبد اللَّه للزوج النصف، وللأم ثلث ما بقي سهم، وللجد سهم، وللأخ سهم، (فإن) (١) كانا (أخوين) (٢) أو أكثر من ذلك فللزوج النصف، وللأم سهم، وللجد سهم، وبقي سهم فهو لإخوته في قول علي وزيد وعبد اللَّه (٣).
Ibrahim states regarding the woman who leaves behind her husband, mother, paternal brother, and grandfather that, according to the statements of Hazrat Ali (may Allah be pleased with him) and Zaid (may Allah be pleased with him), the husband will receive half of the estate, that is, three shares; the mother will receive one third of the estate, that is, two shares; and the grandfather will receive one share. According to the statement of Hazrat Abdullah (may Allah be pleased with him), the husband will receive half of the estate, the mother will receive one third of the remaining estate, the grandfather will receive one share, and one share will be for the brother. And if there are two or more brothers, then the husband will receive half of the estate, and the mother and grandfather will each receive one share, and the remaining share will be divided among the brothers. This is the statement of Hazrat Ali, Zaid, and Abdullah (may Allah be pleased with them).
Hadith 33370
٣٣٣٧٠ - حدثنا وكيع قال: ثنا سفيان عن أبي إسحاق قال: أتينا شريحًا فسألناه عن زوج وأم وأخ وجد فقال: للبعل الشطر، وللأم الثلث، ثم سكت ثم قال الذي على رأسه: إنه لا يقول في الجد شيئًا.
Abu Ishaq narrates that we went to Hazrat Shurayh and asked him about the issue concerning the husband, mother, brother, and grandfather. He said that the husband gets half of the wealth and the mother gets one third of the wealth. Then he remained silent, so the person who was standing by his bedside said, "You do not consider anything for the grandfather." He says that then we went to Hazrat ‘Ubaidah, and he divided the wealth into six parts according to the statement of Hazrat Abdullah (may Allah be pleased with him): three parts were given to the husband, and one part each to the mother, grandfather, and brother. In this way, according to the opinion of all the respected scholars, this issue will be resolved from six parts.
