Hadith 33288
٣٣٢٨٨ - حدثنا ابن فضيل عن بسام عن فضيل عن إبراهيم في امرأة تركت أختها لأمها وأمها ولا عصبة لها فلأختها من أمها السدس، ولأمها خمسة أسداس في قضاء عبد اللَّه، وقضى فيها زيد أن لأختها من أمها السدس، ولأمها الثلث، ويجعل سائره في بيت المال، وقضى فيها علي أن لهما المال على قدر ما ورثا، فجعل للأخت من الأم الثلث وللأم الثلثين (١).
Fudayl Ibrahim narrates that he said regarding the woman who leaves behind her maternal sister and her mother, and has no male agnate heir: the maternal sister receives one-sixth, and the mother receives five-sixths. This is the ruling of Abdullah (may Allah be pleased with him). And regarding this, Zayd (may Allah be pleased with him) said: the maternal sister receives one-sixth of the wealth, the mother receives one-third of the wealth, and the remainder is placed in the public treasury (Bayt al-Mal). And in this matter, Ali (may Allah be pleased with him) ruled that both of them receive the inheritance according to their shares: thus, he ruled one-third of the wealth for the maternal sister and two-thirds for the mother. Abu Bakr says that this issue, according to Ali’s (may Allah be pleased with him) statement, is resolved from three shares, and according to Abdullah’s (may Allah be pleased with him) opinion, from six shares.
