Hadith 33281
٣٣٢٨١ - حدثنا ابن فضيل عن بسام عن فضيل قال: قال إبراهيم في امرأة تركت زوجها وإخوتها لأمها أحرارا، ولها ابن مملوك: فلزوجها النصف ثلاثة أسهم، ولاخوتها لأمها الثلث سهمان، ويبقى السدس فهو للعصبة، ولا يرث ابنها المملوك شيئا في قضاء علي، وقضى فيها عبد اللَّه أن لزوجها الربع سهم ونصف (١)، وأن ابنها يحجب الإخوة من الأم إذا كان مملوكًا ولا يرث ابنها شيئًا، ويحجب الزوج، وأن الثلاثة أرباع الباقية للعصبة، وقضى فيها زيد أن لزوجها النصف ثلاثة أسهم وأن لإخوتها لأمها الثلث سهمان، وما بقي فهو في بيت المال إذا لم يكن ولاء ولا رحم (٢).
Hazrat Fudail says that Ibrahim said regarding the woman who died leaving her husband and her freed maternal brother, while she also had a slave son, that her husband will receive half of the wealth, that is, three shares, and her maternal brothers will receive one third of the wealth, that is, two shares, and the remaining one sixth will go to the 'asaba, and her slave son will not inherit anything according to the decision of Hazrat Ali (may Allah be pleased with him). And in this matter, Hazrat Abdullah (may Allah be pleased with him) decided that the husband will receive one fourth of the wealth, that is, one and a half shares, and the son will prevent the maternal brothers from receiving their share if he is a slave, and will reduce the husband's share, and the remaining three fourths of the wealth will go to the 'asaba. And in this matter, Hazrat Zaid (may Allah be pleased with him) decided that the husband will receive half of the wealth, that is, three shares, and the maternal brothers will receive one third of the wealth, that is, two shares, and the remaining wealth will be kept in the Bayt al-Mal if there is no mawla or any relative from the dhawi al-arham. Hazrat Abu Bakr says that this issue will be resolved from six shares according to the opinion of Hazrat Ali (may Allah be pleased with him) and Hazrat Zaid (may Allah be pleased with him), and from four shares according to the opinion of Hazrat Abdullah bin Mas'ud (may Allah be pleased with him).
