Musannaf Ibn Abi Shaybah

Shaibani narrates that I asked Sha'bi about the paternal aunt: is she more entitled to inheritance or the niece? He replied: Do you not know this matter? I said that the niece is more entitled than the paternal aunt. Abu Ishaq narrates that 'Amir testified about Masruq that he said: Place them in the rank of their fathers.

Shu'bi narrates from Hazrat Masruq that he said: "Place the Dhawi al-Arham (uterine relatives) in the rank of their fathers."

Shaibani narrates that Hazrat Sha'bi said regarding the niece and the paternal aunt that the wealth is for the niece.

Shaibani narrates the statement of Ibrahim that the wealth will be given to the paternal aunt.

Mughira and Mansur narrate the statement of Ibrahim that the jurists used to make relatives heirs according to their relationships.

Shaibani writes that I asked Hazrat Sha'bi about the niece and the paternal aunt: which of them has a greater right to inheritance? He replied, "The niece," and said, "Place them in the rank of their fathers."
