Hadith 33163
٣٣١٦٣ - حدثنا وكيع قال: ثنا إسماعيل بن عبد الملك قال: سألت سعيد بن جبير عن ابنة وابني عم أحدهما أخ لأم، فقال: للابنة النصف، وما بقي فلابن العم الذي ليس بأخ لأم (ولا يرث أخ لأم) (١) مع ولد.
Ismail bin Abdul Malik reports that I asked Hazrat Saeed bin Jubair (may Allah have mercy on him) about a daughter and two paternal cousins, one of whom was a maternal brother. He replied: The daughter gets half of the estate, and the remainder is for the paternal cousin who is not a maternal brother, and the maternal brother does not inherit when there are descendants. The narrator says that then I asked Hazrat Ata, and he said that Hazrat Saeed made a mistake; the daughter gets half of the estate, and the remainder is to be divided equally between the two. Hazrat Abu Bakr says that according to the statement of Hazrat Saeed bin Jubair (may Allah have mercy on him), this issue will be resolved out of two shares: half for the daughter, and half for the paternal cousin who is not a maternal brother. And according to the statement of Hazrat Ata (may Allah have mercy on him), it will be resolved out of four shares: two shares for the daughter, and two shares to be divided between them.
