Hadith 33158
٣٣١٥٨ - حدثنا وكيع عن شعبة عن أوس عن حكيم بن (عقال) (١) قال: أُتي علي في ابني عم أحدهما زوج والآخر أخ لأم فقال لشريح: قل فيها، فقال شريح: للزوج النصف، (و) (٢) ما بقي فللأخ، فقال له علي: رأي، قال: كذلك رأيت، فأعطى عليٌ الزوج النصف، والأخ السدس، وجعل ما بقي بينهما (٣).
Hakeem bin Iqal narrates that a case was brought before Hazrat Ali (may Allah be pleased with him) regarding two paternal cousins, one of whom was the husband and the other was a maternal brother. He asked Hazrat Shurayh, "What is your opinion about this?" Hazrat Shurayh replied, "Half is for the husband and the remainder is for the brother." Hazrat Ali (may Allah be pleased with him) said, "Is this your opinion?" He replied, "This is my opinion." So Hazrat Ali (may Allah be pleased with him) gave half of the wealth to the husband, one-sixth to the brother, and distributed the remaining wealth between the two.
Hadith 33159
٣٣١٥٩ - حدثنا يحيى بن زكريا بن أبي زائدة عن إسرائيل عن منصور عن إبراهيم في امرأة تركت ثلاثة بني عم أحدهم زوجها والآخر أخوها لأمها، فقال ⦗٢٥٩⦘ علي وزيد: للزوج النصف وللأخ من الأم السدس، وما بقي فهو بينهم سواء، وقال ابن مسعود: للزوج النصف، وما بقي فللأخ (من الأم) (١) (٢).
It is narrated from Ibrahim that regarding the woman who left behind three paternal cousins, one of whom was her husband and another her maternal brother, Hazrat Ali (may Allah be pleased with him) and Hazrat Zaid (may Allah be pleased with him) said that half of the estate will be for the husband and one-sixth for the maternal brother, and the remainder will be divided equally among them. And Hazrat Ibn Masood (may Allah be pleased with him) said that half of the estate is for the husband and the remainder is for the maternal brother. Hazrat Abu Bakr said that this issue, according to the opinion of Hazrat Ali (may Allah be pleased with him) and Zaid (may Allah be pleased with him), will be resolved from the number six, of which three parts (i.e., half the estate) will be for the husband, and one-sixth for the maternal brother, and the remaining two parts will be divided between them. And according to the statement of Hazrat Ibn Masood (may Allah be pleased with him), this issue will be resolved from two parts, of which half will be for the husband and the remainder for the maternal brother.
