Hadith 33153
٣٣١٥٣ - حدثنا جرير عن مغيرة عن الشعبي قال: كان علي وزيد يقولان في بني عم أحدهم أخ لأم: يعطيانه السدس، وما بقي بينه وبين بني عمه، وكان عبد اللَّه يعطيه المال كله (١).
Shu'bi narrates that Hazrat Ali (may Allah be pleased with him) and Hazrat Zaid (may Allah be pleased with him) used to say regarding those paternal cousins, among whom one is a maternal brother, that he should be given one-sixth share, and the remainder should be divided between him and the other paternal cousins. And Hazrat Abdullah (may Allah be pleased with him) used to give the entire wealth to that paternal cousin.
Hadith 33154
٣٣١٥٤ - حدثنا وكيع عن سفيان عن أبي إسحاق عن الحارث عن علي قال: أتي في بني عم أحدهم أخ لأم، وكان ابن (مسعود) (١) أعطاه المال كله، فقال علي: يرحم اللَّه أبا عبد الرحمن إنه كان لفقيه، لو كنت لأعطيه السدس، وكان شريكهم (٢).
Harith narrates that a case was brought before Hazrat Ali (may Allah be pleased with him) regarding paternal cousins, one of whom was a maternal brother, while Hazrat Ibn Mas’ud (may Allah be pleased with him) had given the entire inheritance to the maternal brother. Hazrat Ali (may Allah be pleased with him) said: May Allah have mercy on Abu Abdur Rahman, he was indeed a jurist. If it were up to me, I would have given him one-sixth, and then he would have shared the remainder of the wealth with the other paternal cousins.
Hadith 33155
٣٣١٥٥ - حدثنا وكيع عن سفيان عن خالد الحذاء عن ابن سيرين عن شريح أنه كان يقضي في بني عم أحدهم أخ لأم بقضاء عبد اللَّه (١).
Muhammad bin Sirin narrates that Hazrat Shurayh used to judge regarding those paternal cousins, among whom one was a maternal brother, according to the decision of Hazrat Abdullah (may Allah be pleased with him).
Hadith 33156
٣٣١٥٦ - حدثنا ابن فضيل عن بسام عن فضيل عن إبراهيم في امرأة تركت بني عمها أحدهم أخوها لأمها، قال: فقضى فيها عمر وعلي وزيد؛ أن لأخيها من أمها السدس، وهو شريكهم بعد في المال، وقضى فيها عبد اللَّه أن المال له دون بني عمه (١).
Ibrahim states that when a woman died leaving behind paternal cousins, among whom one was her maternal brother, regarding this, Hazrat Umar, Hazrat Ali (may Allah be pleased with them), and Hazrat Zaid (may Allah be pleased with him) gave the verdict that her maternal brother will receive one-sixth, and then he will share in the remainder of the wealth with the others. And regarding this, Hazrat Abdullah (may Allah be pleased with him) gave the verdict that the wealth will go only to him, not to the other paternal cousins of the deceased. Abu Bakr states that this issue, according to the opinion of Hazrat Umar, Hazrat Ali, and Hazrat Zaid (may Allah be pleased with them), will be resolved from six shares, and according to the opinion of Hazrat Abdullah and Shurayh (may Allah be pleased with them), it will be resolved from one share, and that will be the entire wealth.
