Hadith 33122
٣٣١٢٢ - حدثنا ابن نمير قال: ثنا سفيان عن عبد الرحمن بن الأصبهاني عن عكرمة قال: بعثني ابن عباس إلى زيد بن ثابت أسأله عن زوج وأبوين، فقال زيد: للزوج النصف، وللأم ثلث ما بقي وهو السدس، فأرسل إليه ابن عباس في كتاب اللَّه تجد هذا؟ قال: أكره أن أفضل أما على أب، وكان ابن عباس يعطي الأم الثلث من جميع المال (١).
It is narrated from Ikrimah that he says: Hazrat Ibn Abbas (may Allah be pleased with them) sent me to Hazrat Zaid bin Thabit (may Allah be pleased with him) to inquire about the issue of inheritance for the husband and parents. So Hazrat Zaid (may Allah be pleased with him) said that the husband gets half of the wealth, and the mother gets one third of the remaining wealth, and that will be one sixth of the total wealth. Hazrat Ibn Abbas (may Allah be pleased with them) sent a message to him asking, "Do you find this in the Book of Allah?" He replied, "I dislike giving preference to the mother over the father," and Hazrat Ibn Abbas (may Allah be pleased with them) used to give the mother one third of the entire wealth.
Hadith 33123
٣٣١٢٣ - حدثنا حسين بن علي عن زائدة (عن) (١) سليمان قال: كان إبراهيم يفرضها كما فرضها زيد.
It is narrated from Zaidah that Sulaiman said that Ibrahim used to give the same answer to this issue as Hazrat Zaid (may Allah be pleased with him) used to give.
Hadith 33124
٣٣١٢٤ - حدثنا أبو خالد الأحمر عن حجاج عن شيخ عن ابن الحنفية في زوج وأبوين: للزوج النصف، وللأم ثلث ما بقي، وما بقي فللأب.
Hajjaj narrates from a shaykh from Hazrat Muhammad bin Hanafiyyah that in the case where the husband and parents are heirs, the husband receives half of the wealth, the mother receives one third of the remaining wealth, and the rest of the wealth is for the father.
Hadith 33125
٣٣١٢٥ - حدثنا يحيى بن آدم قال: ثنا مندل عن الأعمش عن إبراهيم عن علي وزيد بن ثابت في امرأة وأبوين وزوج (وأبوين) (١) قال: قال للأم ثلث ما بقي (٢).
It is narrated from Ibrahim that Hazrat Ali (may Allah be pleased with him) and Zaid bin Thabit (may Allah be pleased with him) gave a ruling regarding the issue of "wife and parents" and "husband and parents" that the mother receives "one third of the remaining estate."
Hadith 33126
٣٣١٢٦ - حدثنا (عبدة) (١) عن الأعمش أن ابن عباس أرسل إلى زيد يسأله عن زوج وأبوين، فقال زيد: للزوج النصف، وللأم ثلث ما بقي، فقال ابن عباس: تجد لها في كتاب اللَّه ثلث ما بقي؟ فقال زيد: هذا رأيي -واللَّه أعلم (٢).
It is narrated from A‘mash that Ibn Abbas (may Allah be pleased with them both) sent a man to Zaid to inquire about the issue of the husband and the parents, so he said: The husband gets half of the wealth and the mother gets one third of the remaining wealth. Ibn Abbas (may Allah be pleased with them both) asked: Do you find in the Book of Allah that the mother gets one third of the remainder? Zaid replied: This is my opinion; Allah Almighty knows best. Abu Bakr says: These are six shares: three shares for the husband, one share for the mother, and two shares for the father.
Hadith 33127
٣٣١٢٧ - قال أبو بكر: هذه ستة أسهم، للزوج ثلاثة، (وللأم سهم) (١)، وللأب سهمان.
33127 - Abu Bakr said: These are six shares: for the husband three, (for the mother one share) (1), and for the father two shares.
