Musannaf Ibn Abi Shaybah

Mansur narrates from Hazrat Hakam and Hasan that when an heir acknowledges a debt upon the deceased, that acknowledgment will be considered valid within the share of inheritance received by that heir.

Mutarraf reports from Hazrat Sha’bi regarding the heir who acknowledges a debt; he said that the amount of the debt equal to his share will become obligatory upon him. The narrator says that then he (Sha’bi) said that that much will be deducted from his share.

It is narrated from Yunus that Hasan said: That debt will become obligatory upon him to the extent of his share.

Mughira narrates that Hazrat Amir said regarding the man who, at the time of his death, left behind two sons and an inheritance of two hundred dinars. Then one son admitted that their father owed a debt of fifty dinars. He (Hazrat Amir) said that the debt should be taken from the share of the one who made the admission, and the share of the other will remain safe and intact.

It is narrated from Mughira that Hazrat Sha'bi said: When any heir acknowledges a debt upon the deceased, it will be obligatory for him to pay it from his share.
