Those Who Say the Executor's Role Is Permissible and He Is Like a Father
Hadith 33018
٣٣٠١٨ - (١) حدثنا هشيم عن مغيرة عن إبراهيم قال: بيع الوصي جائز.
Mughira narrates from Ibrahim that it is permissible for the executor to sell the property.
Hadith 33019
٣٣٠١٩ - حدثنا الفضل بن دكين عن (شريك) (١) عن الشيباني عن الشعبي قال: الوصي بمنزلة الأدب.
Shaibani narrates from Shabi that the executor (wasiy) is in the position of the father.
Hadith 33020
٣٣٠٢٠ - حدثنا ابن مهدي عن يحيى بن حمزة عن (أبي) (١) وهب (٢) قال: أمر الوصي جائز إلا في الرباع، (وأن باع) (٣) بيعا لم يقل.
Yahya bin Hamzah narrates the statement of Hazrat Abu Wahb that it is permissible to appoint an executor except in the case of lands, and if he sells something, its sale should not be annulled.
Hadith 33021
٣٣٠٢١ - حدثنا وكيع عن يزيد (بن) (١) إبراهيم عن الحسن قال: (ينظر والي) (٢) اليتيم مثل ما يرى لليتيم (يعمل) (٣) (ليتيم) (٤) به.
Yazid bin Ibrahim narrates that Hasan said: The guardian of the orphan should consider carefully, and then whatever he deems appropriate regarding the orphan’s wealth, he should act accordingly.
Hadith 33022
٣٣٠٢٢ - حدثنا وكيع عن شريك عن مغيرة عن الشيباني عن الشعبي قال: الوصي بمنزلة الوالد.
Shaibani narrates from Shabi that the executor (wasiy) is in the position of the father.
