One Who Is Captured by the Enemy—How Much of His Wealth Can He Dispose of?
Hadith 33016
٣٣٠١٦ - حدثنا عبد الأعلى عن هشام عن الحسن في الأسير في أيدي العدو: إن أعطى عطية، أو نحل نحلا، أو أوصى بثلثه: فهو جائز.
It is narrated from Hisham that Hasan said: If a man who has been imprisoned by the enemy gives a gift to someone or makes a will for one third of his wealth, then this is permissible for him.
Hadith 33017
٣٣٠١٧ - حدثنا معن بن عيسى عن ابن أبي ذئب عن الزهري قال: لا يجوز للأسير في ماله إلا الثلث.
Ibn Abi Dhi'b narrates that Zuhri said: It is not permissible for a prisoner to dispose of more than one-third of his wealth.
