Musannaf Ibn Abi Shaybah

Mujahid narrated that Hazrat Umar (may Allah be pleased with him) said: when two armies clash and when a woman is pregnant, they do not have the right to dispose of more than one third of their wealth.

It is narrated from Hisham that Hasan said regarding a person who gives something to someone during war, or during a sea journey, or at the time of plague, or a pregnant woman gives something to someone, that whatever they have given is valid, and it will not be counted within one third of the wealth.

It is narrated from Ash'ath that Hasan said: Whatever disposal a pregnant woman makes of her wealth during the months of her pregnancy will be counted from one third.

Abdul Malik narrates that Hazrat Ata said regarding a person who suffers from tuberculosis or fever and is able to walk around, that any disposal he makes of his wealth will be counted as from his entire wealth, except in the case when he is bedridden (unable to walk).

Ibn Jurayj narrates that Hazrat Ata said: Whatever disposal a pregnant woman makes of her property will be considered a will.

The same statement is also narrated from Hazrat Ata through another chain of transmission.

Aamir narrates the same statement from Hazrat Shurayh.

Yahya bin Saeed narrates that my wife gave a gift during her pregnancy, and this matter was mentioned to Qasim bin Muhammad. He said that this gift will be taken from the entire wealth. Hammad reports that Yahya said: We say that this gift will be from the entire wealth until labor pains begin.

Jabir narrates from Hazrat Amir that the disposal of property by a pregnant woman is subject to the ruling of a will.
